General Field: Biomedical Science

Position at the Time of Case Filing: Postdoctoral Fellow

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Virginia

Approval Notice Date: March 4th, 2016

Case Summary:

With impressive credentials and broad experience in the field of biomedical sciences, a postdoctoral fellow from India qualified to file his I-140 petition under the EB-1A (Alien of Extraordinary Ability) visa category. He contracted North America Immigration Law Group (WeGreened.com) to help him put together a strong petition packet to convince the USCIS that he deserved to get one step closer to a green card. Thanks to his qualifications, our diligent efforts, and Premium Processing, our EB1A petition was approved in merely a week.

What is Premium Processing?

With an additional filing fee of $1,225, Premium Processing (PP) is an expedited service offered by the USCIS for certain visa categories. Petitioners can elect to file their case under PP if they are not willing (or not able) to wait 4-9 months for the USCIS to adjudicate their case. When it comes to PP, immigration officers have to take action within 15 business days, and this significantly shaves down the wait time from months to mere days.

What Makes a Strong EB-1A Case?

Several factors come into play when determining if one qualifies for EB-1A. In this case, our client met three out of the 10 requirements set in place by the USCIS:

  1. Authorship of Scholarly Articles: Our client had 29 peer-reviewed scientific articles to his name.
  2. Judge the Work of Others: When we filed the case, our client had conducted 20 peer reviews for multiple distinguished scientific journals.
  3. High Citation Count: Our client’s work had amassed 367 citations when we filed the case in February 2016, and we have no doubt that his citation count has increased since then.

What are Recommendation Letters?

As part of our services, we helped our client narrow down a list of potential recommenders and selected experts in the field whom he should contact for testimonials. We included the recommendation letters that he managed to obtain into our well-thought-out EB1A petition packet. These letters were furnished by other influential biomedical scientists and they focused on advocating the value of our client’s work on cancer research and pharmaceutical science. These letters helped us establish that our client’s investigations are of the utmost importance to the American healthcare system and overall public health. For instance, one of these letters stated, “[Client] is an outstanding researcher in the fields of anti-cancer drug development, virology, and pharmaceutical science, fundamental areas of study for the improvement of public health in the United States.”

What Next?

There are two consecutive steps to getting a green card: the I-140 petition and the I-485 application. Now that our client’s I-140 has been approved under the EB-1A category, he can move on to I-485, the final step towards permanent residency. Our firm is currently helping him and his spouse put together their I-485 applications, and we look forward to helping them attain their green cards.
