Case Summary:

A research engineer from India engaged the expert services of North America Immigration Law Group (WeGreened.com) to help him realize his dreams of becoming an American permanent resident. As he wanted to file his I-140 petition under the employer-sponsored visa category, EB-1B (Outstanding Professors and Researchers), he needed his employer’s full support before proceeding. Once we had everything we needed (relevant paperwork from our client’s employer and the contract signed by our client), we proceeded with putting together a convincing EB-1B petition.

Amongst other things, we included data on our client’s 7 publications that had gathered 95 citations, and the 14 times he conducted peer reviews for scientific journals. As part of our comprehensive services, we also reviewed our client’s research that addresses numerous problems in mechanical engineering, and in some of his work, oceanography. We were then able to determine the significance of his research to the United States (particularly when it comes to understanding flow in a variety of conditions and technologies, such as in heat exchangers) and establish that he is an asset to the nation. To fortify our claims, we included recommendation letters contributed by other experts working in the field of mechanical engineering. For example, one of these letters contained a statement that noted the importance of our client’s work to other researchers: “[Client’s] research has been cited eighty times as of this writing. This shows his entire body of work is aiding and driving the projects of his peers in the field, and that the impact of what he has produced can be felt throughout the scope of his peers’ works.”

Long road to petition approval:

It was a long and winding road to petition approval (the entire adjudication took 13 months and 13 days). After the case was considered outside the normal processing time, we raised a service request on our client’s behalf. In response, the USCIS informed us that his case was in line to be adjudicated. Nearly 5 months later, our client decided to upgrade his case to Premium Processing to speed up the process. Two weeks after the upgrade, the USCIS issued a Request for Evidence (RFE). Our trained team promptly and effectively responded to the RFE and proved to the USCIS that our client’s credentials are legitimate. The USCIS ultimately approved our client’s EB-1B petition, propelling him one step closer towards a green card. He recently retained us to help him and his wife file their I-485 applications. We look forward to helping them attain permanent residency, and we thank them for working with North America Immigration Law Group.
