General Field: Physics

Approval Notice Date: March 3rd, 2017

Processing Time: 8 Days (Premium Processing Requested)

Case Summary:

North America Immigration Law Group ( had the pleasure of working with a physicist from Germany. As he is residing outside the United States, he will undergo a different process to obtain a green card than those based in the country. The first step (the I-140 petition) remains the same but the difference lies in the second and final step. Instead of filing an I-485 application, our client is now eligible for Immigrant Visa Processing (IVP).

What is IVP?

With his EB-1A petition approval, our client can now apply for an immigrant visa at an American consulate or embassy. Amongst other things, he has to submit the right paperwork, pay the fees, and be interviewed by an officer before he can be granted this visa. Assuming that everything goes well, he will be issued a visa stamp that will allow him to enter the United States as a permanent resident. His green card will then be mailed to his U.S. address.

EB-1A Petition:

It must be noted that before being eligible for IVP, our client first had to obtain an I-140 petition approval. His petition was filed under the EB-1A (Alien of Extraordinary Ability) visa category, and thanks to Premium Processing, the USCIS only spent 8 days adjudicating his case. We have no doubt that our client’s strong credentials and our meticulously prepared presentation played a role in securing case approval. Here are some of the petition’s highlights:

  • We noted our client’s citation count (over 10,000), publication record (over 100), and review experience (over 50).
  • To strengthen our case, we incorporated recommendation letters obtained from other experts in the field. According to one of our client’s recommenders: “During my career, I have had the privilege to work alongside many accomplished researchers, and he is one of the most impressive that I have encountered. In my role as his collaborator, I was able to oversee many of his research projects, and my close familiarity with his work permits me to provide an enthusiastic recommendation of his abilities as a researcher.”
  • As part of our services, we carefully reviewed our client’s research on physics for complex systems. We used what we learned to demonstrate to the USCIS that his work is of great importance to the United States, especially its technology sector.

North America Immigration Law Group ( would like to congratulate our client for obtaining an EB-1A petition approval, and we wish him well with IVP.
