Case Summary:

Not long ago, North America Immigration Law Group (WeGreened.com) helped an oncology fellow from India get his EB-1A (Alien of Extraordinary Ability) petition approved. Although we encountered a significant hurdle along the way (the issuance of a Request for Evidence), we persevered and our client is now much closer to his green card.

What is a Request for Evidence (RFE)?

According to the USCIS website, an RFE is issued when “an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant’s eligibility for the benefit sought.” Our legal team responded to the RFE in an efficient and prompt manner, which satisfied the USCIS and they ultimately granted their approval. From the date we submitted our client’s EB-1A petition to the date he received notification of case approval, our client waited exactly 3 months and 7 days. It would have taken far longer had he not elected to file his case under Premium Processing.

Putting Together a Strong EB-1A Petition:

Our client’s EB-1A petition contained a myriad of information pertaining to his academic and professional performance as a qualified M.D. researcher working in the field of oncology. His research is focused on the prognosis of cancers such as Myelodysplastic Syndrome (MDS) and Acute Myeloid Leukemia (AML), which we proved to be extremely beneficial to the United States medical sector. Furthermore, our client’s extensive experience working in the field has resulted in 2 published scientific papers that had amassed 89 citations at the time of filing. Our client had also conducted 7 peer reviews for high impact scientific journals, which denoted the importance of his opinions to other researchers in the oncology community.

Obtaining a Green Card:

A little over a month after our client’s EB-1A petition was approved, we helped him file I-485 applications for himself and his wife. As this is the final step in the green card process, they will become permanent residents once the USCIS approves their applications. We join them as they await good news from the USCIS.
