Case Summary:

A postdoctoral research associate from China hired North America Immigration Law Group (WeGreened.com) to help him get one step closer to green card success. Our client, who is an expert in the field of plastics engineering, opted to file two I-140 petitions to increase his odds of obtaining a petition approval; he went with EB-2 NIW (National Interest Waiver) and EB-1A (Alien of Extraordinary Ability), and received both approval notices less than 3 weeks apart.

Overlapping Evidence:

EB-1A and EB-2 NIW are two different visa categories with vastly different requirements. Even so, the petition packets that we put together for our client contained several similarities. These included data on his Ph.D. in Plastics Engineering, the 98 citations to his work, and his 17 publications. He had approached six experts in the field of plastics engineering and requested for recommendation letters, all of whom agreed to help. These letters served as additional evidence that our client is at the forefront of a fast-paced field, and that he will continue producing research results that are beneficial to the United States’ energy independence and environmental welfare. For instance, one of his recommenders stated that “[Client] has improved our basic understanding of structure-property relationships in bio-based polymers as well as the rheological properties of nanocomposites. Without [Client’s] ongoing research efforts, the United States risks considerable delays in the advancement of the bio-based plastics industry, hampering the economy and placing unnecessary burdens on the environment.”

Obtaining a Green Card:
We congratulate our client for obtaining two petition approvals, but we are especially pleased with the approval of his EB-1A petition. This allows him to file an I-485 application (final step in the green card process) without having to wait several years. Our client recently informed us that he will be using our D.I.Y.
