Case Summary:

This EB-1A (Alien of Extraordinary Ability) case saw a gifted bioinformatics scientist from China reach out to North America Immigration Law Group (WeGreened.com) for help with his I-140 petition (first of two steps in green card proceedings). After carefully evaluating his credentials, we agreed that he qualified to file his I-140 petition under the EB1A visa category.

Premium Processing:

Only available for select visa categories, Premium Processing (PP) is an option that expedites adjudication. Instead of waiting 4-9 months for a response from the USCIS, petitioners who file their case under PP only have to wait 15 days for the immigration officers to take action on their petition. Thanks to PP, our client received an approval notice from Nebraska Service Center merely eight days after we filed the case on his behalf. Now that he has an EB1A approval notice, he is free to file an I-485 application (final step in the green card process).

EB-1A Petition:

In this case, we determined that our client met three out of the 10 requirements set by the USCIS to qualify for EB-1A. They are as follows:

1. Judge the work of others: Our client’s peer review experience is extensive—he has conducted nearly three dozen reviews for multiple high impact scientific journals.
2. Authored scholarly articles: When we filed the case, our client had 9 published journal articles and two conference articles to his name.
3. Made significant contributions: According to Google Scholar, our client’s work had gathered 216 citations at the time of filing.

We used these impressive credentials to prove to the USCIS that our client is an asset to the United States. Furthermore, we demonstrated that as a respected bioinformatics professional, he is significantly contributing to the overall advancement of the field.

Recommendation Letters:

To further fortify our EB-1A petition packet, we urged our client to touch base with other influential researchers in the field and request for recommendation letters. Several internationally renowned researchers agreed to lend their support, one of whom wrote, “[Client’s] research exerts a major influence on the field…[and] is recognized as highly valuable around the world.” These letters verified that our client is a respected member of the scientific community and that his I-140 petition should be approved.
