Case Summary:

A recent client of ours was described as “a leading veterinary virologist whose efforts are imperative to the future success of many different facets of research and industrial sectors in the United States.” These words of support are excerpted from a recommendation letter contributed by an expert virologist. This letter, along with five others signed by other influential researchers, served as evidence that our client—a postdoctoral research associate from China—deserved to obtain EB-1A (Alien of Extraordinary Ability) petition approval.

When our client approached our firm (North America Immigration Law Group) for help to overcome the first hurdle in the green card process (filing an I-140 petition), we carefully evaluated her credentials to be sure that we could build a strong case for her. After confirming that her credentials were noteworthy enough to qualify for EB-1A, we initiated an attorney-client relationship and got to work building a strong case for her. Our goal was to prove to the USCIS that our client met at least 3 out of the 10 EB-1A requirements. These are the criteria we focused on:

  1. Publication Count: We listed the 8 peer-reviewed scientific articles to her name and noted that they had been published in some of the most prestigious, high impact journals in her field of virology. This proved that her work is consistently recognized as some of the best in the field.
  2. Citation Record: At the time of filing, our client’s work had been cited 147 times by independent and dependent researchers, indicating the major significance of her investigations on various animal viral diseases and on developing novel vaccines against both animal and human infectious diseases.
  3. Peer Review Service: When we filed our client’s EB-1A petition, she had already conducted 30 peer reviews for various scientific journals. As only top-rated researchers are invited to assess the work of their peers, our client’s impressive peer review record speaks volumes of her high standing as a virologist.
Thanks to Premium Processing (PP), our client obtained petition approval merely 10 days after filing. PP is a premium service offered by the USCIS: petitioners have to pay an additional $1,225 to have action taken on their cases within 15 calendar days (a far cry from the 4-9 months it usually takes the USCIS to adjudicate I-140 petitions).

The approval of this petition is another example of our firm’s stellar record of helping our clients get closer to their green cards. We thank our client for selecting us to represent her EB-1A case and we wish her the best as she files an I-485 application using our free D.I.Y. Packet.
