EB1-A (Alien of Extraordinary Ability) Approval Received on December 2nd, 2013 for a Postdoctoral Researcher in the Field of Molecular Oncology (Approval Notice)

General Field: Molecular Oncology

Position at the Time of Case Filing: Postdoctoral Researcher

National Origin:  India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing:  Illinois

Approval Notice Date: December 2, 2013

Processing Time:  5 months, 14 days

Case Summary:

In this case, we had the opportunity to represent a Postdoctoral Researcher from India working in the field of molecular oncology.  Prior to retaining us, he had filed under EB-1A and his petition was denied.  The primary focus of his work had been investigating the use of human umbilical cord blood stem cells (hUCBSC) for the treatment of glioma and exploring the causes of stemness and its relationship to metastasis in glioblastoma.  Not only had his original studies provided a comprehensive analysis of the underpinnings and biological interactions of the mechanisms of cancer development and metastasis, but they also supplied clinicians with the foundation necessary to develop more effective treatment strategies for some of the most fatal types of brain cancer.  His work had resulted in at least 19 peer-reviewed scientific articles, 15 conference proceedings, 1 book chapter, and 4 GenBank submissions- an extremely productive record compared to that of his colleagues in the shared field of endeavor.  At the time that his case was filed, these publications had been cited at least 99 times by researchers around the world.  This served as objective evidence of his sustained international acclaim and his major influence and impact on his field.  In addition, he held positions on the editorial boards of 6 internationally-circulated scientific journals and, as an ad hoc reviewer, had reviewed at least 60 manuscripts for 13 internationally-circulated scientific journals.  The importance of his work is summarized by the following quote from an independent recommender, “Being well-experienced in the field myself, I have an understanding of the significance of [his] research and outstanding contributions to his field. [He] is one of the very few who are outlining some of the most pressing issues regarding cancer treatment through the use of stem cells.” It was our aim to prove that our client qualified for classification as an Alien of Extraordinary Ability, as he sought to remain in the United States to continue working in the field of molecular oncology, and that his continued work would substantially and prospectively benefit the United States. With the documentation that we provided, his case was approved in 5 ½ months.
