The average processing time for I-140 cases is 4-6 months. But on many occasions, we have cases approved far faster than the average processing time. In this instance, the case was approved in just 1 month, which included the time to respond to RFE.

We recently received an EB-1B approval for a Postdoctoral Research Associate in the field of Materials Science. The beneficiary’s outstanding ability, highly skilled background, and impressive record of achievement provided a strong case for his EB1B petition. Specifically, his work focused on developing a better understanding of pharmaceutical agents which in turn leads to development of new pharmaceutical treatments. At the time of filing the beneficiary’s research work had resulted in at least 9 peer-reviewed scholarly articles accepted or published in leading international journals and numerous conference posters and presentations. Furthermore, the beneficiary’s publications had been cited at least 54 times by researchers around the world. In addition, he had been invited to review articles for 6 prestigious journals in the field. The petitioner in this case was a university. It was our goal to prove that this beneficiary qualified for classification as an outstanding professor or researcher given the international recognition for his outstanding achievements. While we had adequately proved that the beneficiary qualified as an outstanding researcher in the petition, we received an RFE stating that we had not provided evidence that the beneficiary had at least 3 years of experience in the field, another requirement of EB-1B. We quickly addressed the RFE, submitting an employment letter verifying that the beneficiary had indeed been employed for at least 3 years, and the case was swiftly approved 2 weeks after the submission of the RFE response. In total, the case was processed in just 1 month.
