Success Stories: We Helped a Postdoctoral Researcher from China in the Field of Electrical Engineering Achieve NIW Approval, Now Awaits EB-1A Approval

Client’s Testimonial:

“Thank you so much for your help! It is so glad to hear my NIW getting approved.”

On September 15th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the field of Electrical Engineering (Approval Notice).

General Field: Electrical Engineering

Position at the Time of Case Filing: Postdoctoral Researcher

Country of Origin: China

State of Residence at the Time of Filing: Texas

Approval Notice Date: September 15th, 2021

Processing Time: 9 months, 26 days

Case Summary:

With a Ph.D. in electrical and computer engineering and fundamental research experience, undoubtedly, our client possesses the ability to advance in the field of computer science. When he contacted our law firm to file an I-140 NIW (National Interest Waiver) petition on his behalf, we examined more into his degrees and diplomas, and after thoroughly evaluating his credentials, we established that we would lead him to NIW success and countersigned the retainer agreement.

We intended to prove that he is an essential researcher in his field of electrical engineering, therefore we added essential attributes to his NIW (National Interest Waiver) petition packet. We noted that his work has been cited 119 times by dependent and independent researchers, demonstrating that his publications are widely recognized and relied upon in his chosen field. We also detailed his contributions to peer-reviewed conference articles which resulted in 9 peer-reviewed journal articles (5 of them first-authored). Furthermore, we discussed how our client has been invited to conduct peer reviews at least 16 times for elite venues in the field due to his knowledge and expertise in nano-optics and 2D materials. Since, only the most highly esteemed researchers in the field are requested to assess the work of their peers, especially in authoritative journals our client is seen as very knowledgeable and an expert in his field.

Moreover, our client’s work related to nano-optics has great substantial merit and national importance. Among other applications, his research is relevant to improving nanoscale imaging techniques and the development of the nanotechnology field. His research has addressed several prominent issues in nano-optics such as nanofocusing for tip-enhanced Raman spectroscopy and developing efficient and cost-effective silver nanowires for nano-imaging, which is useful in facilitating future research at the nanoscale. Specifically, he will continue his work on developing high spatial resolution microscopes for human-machine interface imaging, CMOS-compatible photonic crystal platform design, and the application of machine learning to nanophotonics.

Additionally, our client’s work was discussed in an article published in a well-reputed journal wherein the authors discussed the advantages of his lens-free setup for optimizing scanning near-field optical microscopy. Such coverage demonstrates the high degree of recognition that his research has received from the field. Also, his work on nanofocusing is unique in the field due to its high concentration power without the need for expensive equipment, is aligned with his proposed endeavor, and serves as further evidence of his success in electrical engineering to date.

To bolster our client’s case further, we added recommendation letters signed by four other expert scholars in the field, one of whom stated:

“To continue maximizing the United States' investment [sic] AgNW technology and maintain low energy costs, [client] must be allowed to continue his research domestically. His environmentally friendly, low-cost, high-performance approach provides further avenues of exploration for researchers investigating nanomaterials and nanotechnology energy applications in the United States.”

Thus, our client’s education, experience, expertise, record of publication and citation, and history of successful research in the field all indicate that he is well-positioned to advance the proposed endeavor. We are pleased that our efforts and hard work, in this case, paid off well in proving that our client’s major contributions in his field of expertise make him an invaluable asset to the United States, thus, he received his NIW (National Interest Waiver) approval. He has retained our firm for his EB-1A approval as well. Therefore, we thank him for choosing the North America Immigration Law Group to represent his case and wish him very well as he continues to advance in his proposed field.
