Case Summary:

A postdoctoral fellow based in Illinois, whose research encompasses improving the quality of living for patients with dementia inducing virus, approached North America Immigration Law Group (NAILG) to assist her with the EB-2 NIW (National Interest Waiver). Our team set out to build a strong case to convince the USCIS that our client’s continued presence in the country is in the nation’s best interest.

The various steps in the process:

  • We worked diligently to provide ample evidence that our client is a prolific virologist. For one, we indicated that his work is focused specifically on encephalitis stimulating virus and dementia inducing virus, with the ultimate goals of developing vaccines and treatments for these diseases and ameliorating the subsequent consequences caused by the infections. These studies have resulted in 4 peer-reviewed journal articles (2 of them first-authored).
  • We also focused on demonstrating that our client’s studies have influenced his peers working in the field of virology. To prove our point, we listed the citation count collected from his publications, which stood at 52 at the time of filing.
  • To strengthen her case, our client also reached out to other expert virologists who were familiar with his work. He requested for recommendation letters that confirmed the importance of her contributions to the field. One of hisrecommenders wrote: “[Client]’s research has already affected the state of encephalitis stimulating virus research to a tremendous extent, evidencing the benefits of his achievements. By discovering new approaches to understanding and treating the virus, [Client] has significantly advanced our knowledge and has impelled new research in the field.”
Obtaining the national interest waiver:

In the end, we were successful in building a strong case that proved our client’s research is crucial for improving therapeutic options for dementia patients as well as for prevention of encephalitis. After a long wait of 13 months, our client received news of petition approval, which was adjudicated based on the Matter of Dhanasar*. We congratulate her on this win and thank her for working with us.
