Case Summary:  

We are pleased to share the success story of an I-140 EB-2 NIW (National Interest Waiver) approval for a researcher working on public health and artificial intelligence. The client holds a Ph.D. in Geoinformatics and pursued NIW classification based on a research-driven endeavor with clear, substantial merit and national importance. Although the case received a Request for Evidence, it was ultimately approved after a strategic response that clarified the endeavor’s value and the client’s strong positioning to advance it.

Transforming Public Health Through Machine Learning

As an expert in the field of public health, the client’s proposed endeavor is to continue developing machine learning and deep learning models to identify potential risk and protective factors across multiple social and environmental dimensions. The goal is to better understand how these layered factors shape health behaviors and health outcomes, particularly among vulnerable demographic groups, including children and older adults.

In the petition, we framed this endeavor as nationally important because it supports more precise, data-driven insight into how environment and social conditions influence health disparities over time and across communities. We also emphasized that the client’s work enables researchers and stakeholders to detect patterns that may be difficult to uncover using traditional approaches, helping inform more targeted prevention strategies and more equitable public health decision-making.

At the time of filing, the client had authored 28 peer-reviewed journal articles (including 9 first-authored) and 3 abstracts. The client’s published body of work had received 656 citations.

We did not present these metrics as automatically sufficient. Instead, we explained how an adjudicator could reasonably interpret the citation record as independent evidence that other researchers are relying on the client’s methods and findings. We also presented context showing that multiple papers have performed at notably high citation levels relative to their publication years, which helps translate a raw citation count into clearer evidence of field influence.

The petition further documented at least 36 completed peer reviews. We positioned this as additional recognition because journals typically rely on reviewers with demonstrated expertise and sound judgment to evaluate originality, rigor, and technical validity. This record supported the conclusion that the client is trusted by the broader research community.

The petition also described that the client is currently conducting research at a U.S. academic medical institution, reinforcing that the client is actively engaged in this line of work and positioned to continue advancing the proposed endeavor in the United States.

After receiving the RFE, we prepared a detailed response that reinforced the endeavor’s substantial merit and national importance, clarified how the client’s publication record, citation influence, and peer-review activity demonstrate strong positioning, and addressed why granting the waiver benefits the United States by enabling continued progress in this timely research area. USCIS approved the NIW petition, reflecting the strength of the evidence and the clarity of the overall case presentation.
