Case Summary:

North America Immigration Law Group was approached to file an EB-2 NIW (National Interest Waiver) petition for a postdoctoral scholar holding a Ph.D. in mechanical science and engineering and researching the field of machine learning. As a part of our legal services, we evaluated his professional achievements and academic accolades and confirmed that our client displayed the ability to secure the national interest waiver approval. Thus, we agreed to countersign the client-attorney agreement and ensured the required documents to be presented to the USCIS. We detailed the following in our custom-built petition packet:

  • We focused on his research on devising and implementing machine learning algorithms to improve decision-making policies for human-robot interactions, medical applications, and autonomous vehicles. We concluded that his research is of great importance because of its value to UAVs, also known as unmanned aircraft systems (UAS) or drone technology. Therefore, his research is relevant to electric vehicles and UAVs.
  • Additionally, we noted the 73 citations garnered from the 8 peer-reviewed scientific articles (6 of them first-authored) and 2 U.S. patents he published. Besides, his research related to the proposed endeavor has been supported by funding from a leading agency, including grants from the National Science Foundation (NSF), which is dedicated to advancing scientific progress, promoting national health goals, and securing national defense, thereby demonstrating another measure of his success in pursuing his intended work.
  • Considering the publication of his work in peer-reviewed articles, the patents his work has received, and his project funding made important progress toward his research.
  • Also, our client is an active member of the scientific community and completed 22 peer reviews. This proves that he is very knowledgeable in the field.
  • Furthermore, we added five recommendation letters that he gathered from other foremost experts in the field, asserting that our client’s research is highly beneficial to the United States and deserved to continue his stay in the U.S. One of his recommenders stated:
“[Client] has been an asset to the electric vehicle industry, with the electrification of transportation bringing numerous benefits to this country. One major benefit is a decrease in the use of fossil fuels, which will eventually result in the reduction of environmentally harmful emission gases and pollutants...His groundbreaking research has resulted in several major accomplishments for the existing design and the performance of electric vehicles, which facilitates their greater usage in American society. His work is thus of incalculable importance to the economic and environmental sustainability goals of the United States.”

We are delighted that our client successfully achieved his EB-2 NIW approval and we could provide him the required support. We would like to thank him for trusting us throughout the process and allowing us to be a part of this success story.
