Case Summary:

While the O1-A visa benefits aliens of extraordinary ability in the sciences, arts, education, business, or athletics, those foreign nationals should at least have:

• Sustained national/international claim;
• Their achievement must be recognized in the field through extensive documentation;
• Current/previous employment in a critical or essential capacity for organizations or establishments that have a distinguished reputation.

The NIW petitioners on the other hand must fulfill the below-mentioned prerequisites:

• The foreign national must be in a position to advance the proposed endeavor;
• The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2;

After completing his ME in mechanical and aerospace engineering, our client, currently a Ph.D. candidate from Iran, approached us to file his NIW (National Interest Waiver) and O1-A (Individuals with Extraordinary Ability or Achievement) petitions on his behalf.
