Success Stories: An Iranian Ph.D. candidate working in the Field of Mechanical Engineering Received NIW as well as O1-A Approval with the help of NAILG’s teamwork

Client’s Testimonial:

“Thank you, it was a pleasure working with your team! Your services for the I-140 process were excellent and I would give five stars to it. The unlimited inquiry service was great since it reduced the stress of the paperwork by giving detailed answers to all my questions. I would definitely recommend you to my friends and colleagues. Thank you!”

On July 2nd, 2021 and January 6th, 2022, we received another EB2-NIW (National Interest Waiver) and O1-A (Individuals with Extraordinary Ability or Achievement) approval for a Ph.D. candidate in the Field of Mechanical Engineering (Approval Notice).

General Field: Mechanical Engineering

Position at the Time of Case Filing: Ph.D. candidate

Country of Origin: Iran

State of Residence at the Time of Filing: Illinois

Approval Notice Date: July 2nd, 2021 (NIW) and January 6th, 2022 (O1A)

Processing Time: 8 months, 13 days (NIW), and 10 days (O1A) (Premium Processing Requested)

Case Summary:

While the O1-A visa benefits aliens of extraordinary ability in the sciences, arts, education, business, or athletics, those foreign nationals should at least have:

  • Sustained national/international claim;
  • Their achievement must be recognized in the field through extensive documentation;
  • Current/previous employment in a critical or essential capacity for organizations or establishments that have a distinguished reputation.
The NIW petitioners on the other hand must fulfill the below-mentioned prerequisites:
  • The foreign national must be in a position to advance the proposed endeavor;
  • The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2;
  • A proposed endeavor, holding substantial merit and national importance.
After completing his ME in mechanical and aerospace engineering, our client, currently a Ph.D. candidate from Iran, approached us to file his NIW (National Interest Waiver) and O1-A (Individuals with Extraordinary Ability or Achievement) petitions on his behalf.

His research addresses some of our nation’s most pressing issues in developing and employing autonomous robots. To wit, the National Science Foundation (NSF) and the National Aeronautics and Space Administration (NASA) funded his research, which is a clear demonstration of our client's findings’ novelty and national value in space exploration.

Consequently, to make a strong case in his favor, we included the following details in his petition packet:

  • His work has resulted in four peer-reviewed scientific journal articles, two full-length, peer-reviewed conference publications, and one technical note.
  • His publications have been cited at least 48 times according to Google Scholar.
  • He has completed at least 9 peer reviews.
He has even received 5 recommendation letters from his fellow experts in the field, one of whom remarked:

“....In one of the projects [Client] collaborated on in my department, he personally fabricated a number of innovative soft robot designs and analyzed their benefits in peer-reviewed research papers. In this way, he has leveraged his deep knowledge of mechanical engineering and robotics to improve the technological outlook within the United States.”

Eventually, he received his NIW approval, despite waiting for a longer duration of time. He even acquired his O1-A visa approval in just 10 days (thanks to premium processing). We are glad to be a part of his success journey and wish him a flourishing life ahead.
