Case Summary:

North America Immigration Law Group (NAILG) was approached by a Pennsylvania -based pathology fellow to help him file an EB-2 NIW (National Interest Waiver) petition. Upon initial assessment of his academic profile, we noted that he holds a Bachelor of Medicine and Surgery and has thorough experience in the field. Furthermore, we established that his studies map the occurrence and behavior of cancers by addressing the relevance and role of genetics in the development of diseases. Our goal was to prove that our client is contributing to the United States’ leadership in medicine and to the strength of its healthcare system.

Our client’s 12 peer-reviewed journal articles (3 of them first-authored) had garnered of 72 citations at the time of filing the petition. His broad background in molecular biology, genomics, and pathology has drawn praise from several experts whose recommendation letters were incorporated into the NIW petition. One of them—an assistant professor of oncology—wrote: “This expertise makes him particularly well-suited [to] address the challenges associated with research in solid tumors and general cancer research. As cancer has long been among the most devastating diseases plaguing the country, this expertise is direly needed.” These recommendation letters lent a hand in convincing the USCIS that our client’s work is of national importance and that on balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.
