Case Summary:

Exactly 8 months and 9 days after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a prominent house officer working in the field of cardiovascular science, Texas Service Center granted their approval. Our client obtained his M.B.B.S. from a well-known university in his birth country of India and has spent many years immersed in his area of study. Among other achievements, his dedicated research efforts have resulted in the publication of 10 well-received scientific articles that had gathered 127 citations at the time of filing.

“There is a desire to keep healthcare costs down and avoiding unnecessary procedures is a top concern of all healthcare professionals. [Client's] study provided important information in this regard and is likely to help decrease inappropriate use of expensive medical procedures.” –Assistant Professor, USA

The assistant professor noted above was one of our client’s four expert recommenders, and the quote listed above is an excerpt from his well-written recommendation letter. He and his peers contributed letters that confirmed the value of our client’s comprehensive research on advanced heart transplantation techniques and the development of advanced ventricular assist devices. Thanks to their letters and the wealth of information that we had gathered on our client’s various accomplishments, we were able to establish that our client is a force to be reckoned with in the U.S. medical sector, especially considering how cardiovascular doctors and surgeons employ the most advanced treatments and devices to ensure that heart failure patients receive the best care. Our client’s examination of ventricular assist devices is contributing to improving the most commonly used methods for treating Americans with heart disease, which is a substantial public health concern in the United States.

Filing an I-485 application:

Although our client has successfully overcome this massive hurdle in the green card process, he is unable to file an I-485 application until his priority date becomes current. India-born green card applicants with approved EB-2 NIW petitions can only adjust their status for permanent residence when their priority date becomes current. In this case, our client has to wait several years. He can choose to wait for this day to come or improve his credentials and file another I-140 petition under an EB-1 visa category (such as EB-1A). Applicants born in India with approved EB-1A petitions need not wait several years for their priority date to become current to file an I-485 application. No matter which option he chooses, we look forward to helping him accomplish his goal of obtaining a green card. We thank him for working with our law firm, and we wish him well as he continues to progress the American medical sector.
