Success Stories: A Postdoctoral Fellow in Pharmaceutical Sciences from Vietnam Wins NIW Approval without RFE, with Our Diligent Efforts

Client’s Testimonial:

“It seems impossible and overwhelming until it’s done. Chen immigration team made it seems easy. They are very professional, as compared to my personal experience with other team. To name a few: (1) Chen has a dedicated secured sever to upload all your documents. The sever also allows smooth communication, and Chen’s team is highly responsive. (2) Chen’s team work zealously on my case to the point. (e.g. more supporting letters needed than I expect, double check everything before filing). (3) The procedure for I-140 preparation and filing is well established so you don’t feel lost during the process. You are well guided throughout the process. (4) You got the best quality service for the money you spent. With a petition letter, reference letters, step-by-step guidance, and countless inquiries.”

On March 16th, 2022, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Pharmaceutical Sciences (Approval Notice).

General Field: Pharmaceutical Sciences

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: Vietnam

State of Residence at the Time of Filing: Texas

Approval Notice Date: March 16th, 2022

Processing Time: 3 months, 7 days

Case Summary:

As an expert in the field of pharmaceutical sciences, our client from Vietnam had a proposed endeavor to continue his research on combating medical conditions, such as pulmonary disease and viral pathogens, by developing inhalable drug delivery systems, such as inhalable dry powders. It was evident that his work was of great importance because it directly addresses problems of drug contamination, an issue prominent in middle- and lower-income countries worldwide. It was due to this that one of his recommendations read:

“[Client’s] research contributions on contamination help to dramatically reduce the risk and ensure that the global pharmacy industry can meet the demand for therapeutics, even as the demand continues to grow rapidly. Considering his excellent contributions to the pharmaceutical sciences and the importance of his ongoing research in the field, I believe that it is essential that [the client] continue his current research trajectory.”

On the other hand, due to its clear national importance, his research has in fact been supported with funding from the National Institute of General Medical Sciences (NIGMS), a division of the National Institutes of Health (NIH). He has also completed at least 2 reviews to date. His research has resulted in 6 peer-reviewed journal articles (ALL of them first-authored). These publications have been cited a total of 80 times according to Google Scholar. He had also gathered 4 letters of recommendation from other experts. One of them said:

“[Client’s] research is in alignment with the federal government’s interests in supporting the pharmaceutical sciences. [Client’s] research, which is focused on preventing the contamination of pharmaceutical products by microbial agents, supports this industry by ensuring that the products these firms develop, manufacture, and sell to the American public are safe and effective. With such an important motive behind his past and ongoing research, I believe it is prudent that [the client] be allowed to continue his current work.”

Recommendations like this one helped a great deal in promoting his case at the USCIS. They ensured the victory of his case by corroborating the information presented in the petition. While these specific research contributions represent only a subset of his most successful endeavors, the examples we included were indicative of the overall quality of his research and helped us illustrate his particular expertise and ability to continue contributing significantly to his field and to advancing the proposed endeavor. Thus his education, experience, and expertise in his field, the significance of his contributions, and his past record of success position him well to continue to advance his proposed endeavor.

So, when the news of his NIW approval came in, we were very glad to have had the opportunity to work with him. We thank him and wish him the very best in all future endeavors.
