Success Stories: Taiwanese Postdoctoral Researcher in Texas in the Field of Oncology Receives Green Card Approval Notice

Client’s Testimonial:

“I received the decision last night and my [I-140] case was just approved. Thanks again […] I am glad to tell you that my husband’s and my I-485 have been approved. Although we did not use your I-485 service, your DIY package was very useful and saved us lots of time on searching necessary information. I definitely will recommend you to anyone who needs immigration service.”

On March 2nd, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Oncology (Approval Notice).

General Field: Oncology

Position at the Time of Case Filing: Postdoctoral Researcher

Country of Origin: Taiwan

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Texas

Approval Notice Date: March 2nd, 2016

Processing Time: 10 months, 21 days

Case Summary:

A postdoctoral researcher from Taiwan recently received news that both her I-140 petition and I-485 application (the two steps in the green card process) were approved. She is now an official American permanent resident.

The EB-2 NIW Case:

After carefully evaluating our client’s qualifications, we asserted that she should file her I-140 petition under the EB-2 NIW (National Interest Waiver) visa category. Here are some reasons why our client qualified for the national interest waiver:

  • Outstanding Research: Our client’s work in the field of oncology focuses on uncovering the underlying molecular and genetic causes of several key types of cancer—prostate, cervical, endometrial, colon, liver, and brain cancer. We argued that her research findings benefit modern medicine and biomedical investigations, and that they have led to important advances in applied cancer research. Furthermore we convinced the USCIS that our client’s work advances the United States healthcare industry.
  • Notable Citation & Publication Count: When we filed our client’s NIW case, her 10 published journal papers had amassed 109 citations.
  • Advanced Degrees: Our client’s M.Sc. and Ph.D. in Life Sciences (obtained from a top university in her birth country of Taiwan) serve as evidence that she is equipped with the theoretical knowledge to carry out outstanding practical research.

To further fortify our EB-2 NIW petition, we included recommendation letters offered by other prominent oncologists in the field. In one of the letters contributed by a well-known professor, our client was described as: “… few researchers have had the stellar track record of [Client], or possess the excellent qualities and training that [Client] has already applied so successfully. As a result of her ongoing research, many in the US will benefit from her contributions.”

In Conclusion:

The USCIS spent 10 months and 21 days adjudicating our client’s I-140 petition before granting their approval (we raised a service request on her behalf when the processing time went beyond the average timeframe). Our client elected to file I-485 applications for herself and her husband independently using our comprehensive D.I.Y. Packet (only available to clients who engaged our I-140 services). As our client chose to file her I-485 while her I-140 was pending, she received the I-485 approval notice less than two months after the first approval. North America Immigration Law Group would like to extend our congratulations to our client and her husband for attaining their green cards, and we wish them all the best.
