Case Summary:

North America Immigration Law Group was hired by a Ph.D. student from Taiwan to assist him in filing an I-140 NIW(National Interest Waiver) petition on his behalf. Formed on his accurate credentials, he seemed to be a meritorious candidate to secure a national interest waiver. Once we consented to the terms of our retainer agreement, we started building a substantial case for our client.

According to the matter of Dhanasar (The analytical framework for assessing eligibility for National Interest Waiver), the USCIS needed the following information in our client’s petition packet:

  • The foreign national is a member of the professions holding an advanced degree;
  • The foreign national proposed endeavor has both substantial merit and national importance;
  • The foreign national is well-positioned to advance the proposed endeavor; and
  • On balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.

To ensure that our client continues his research work in the U.S., we detailed all the 34 citations assembled from the 3 peer-reviewed journal articles (1 of them first-authored) he published. Also, these papers have been published in highly acclaimed journals in our client’s field, which indicates his dedication to this area.

Moreover, we observed that his research projects have been funded by the U.S. National Science Foundation, which is the only federal agency whose mission includes support for all fundamental scientific and engineering fields to promote scientific progression that advances the national interest. This funding, therefore, demonstrates the significance and national importance of his research.

Furthermore, we demonstrated his research on improving the productivity and efficacy of the extraction of photosynthetic microorganisms using genetic engineering techniques to enhance sustainable biofuel and decrease the production cost of microbe-based bioproducts. His proposed endeavor is preeminent because it has promoted the increased use of alternative biofuels that reduce the impact of fossil fuels on the environment.

Going forward, it was essential for us to include the recommendation letters into his petition as our client managed to produce five recommendation letters from the other renowned experts rendering further understanding into the merit of this endeavor. One of the recommenders expressed:
