Case Summary:

A postdoctoral fellow in the field of molecular biology contacted North America Immigration Law Group to support him in documenting and filing an EB-2 NIW (National Interest Waiver) petition on his behalf. Before taking up his case, we evaluated his professional and academic recognition. Our client’s proposed endeavor focuses on seeking out new biomarkers for cancer and other diseases as well as elucidating the mechanisms of intercellular RNA transport for the development of new therapeutic agents. His research work is of great importance because it contributes to a global effort for reducing the prevalence of cancer, making him a suitable candidate for the EB-2 petition. To persuade the USCIS that our client holds an excellent standing in his field, we added the following required details in our petition packet:

  • We noted his 11 peer-reviewed journal articles (4 of them first-authored) which accumulated 137 citations. His research provides other scientists with imperative methods and results that explain subsequent findings, thereby establishing the importance of his work. In addition, our client also conducted one review for molecular and cellular biochemistry. This important peer-review activity affirms our client’s expertise in his field.
  • We have assessed his findings and greatly believe that he has extensive knowledge and experience in this area, the significance of his contributions, and his past record of success position him well to continue progressing in his proposed project.
  • To further corroborate his education, experience, and research in his field, we included the recommendation letters gathered from four other experts in the field. One of the professors from a well-known University expounded our client’s work as:
“[Our Client’s] research elucidates the molecular processes related to lung cancer and provides a notable biomarker….His research improves public health in the United States by increasing the understanding of lung cancer development and progression.”

Given that, we were successful in convincing the USCIS that our client contributes to the national effort of improved cancer treatment strategies in the United States, and our client received his NIW approval which moved him one more step closer to the green card processing.

We thank our client for trusting and working with us. We wish him well as he continues to pursue his initiated field.
