On April 25^th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Molecular Biology (Approval Notice).

Case Summary:

Last year, a gifted postdoctoral fellow from Italy hired North America Immigration Law Group to represent her EB-2 NIW (National Interest Waiver) petition and I-485 application. We are extremely pleased to note that our diligent efforts paid off and that our client is now the proud holder of a green card. In preparing her EB-2 NIW petition, here are some of the things that we did to present a strong case to the USCIS:

1. We noted our client’s Master’s in Medical Biotechnology and her Ph.D. in Cellular & Biomedical Sciences, and determined that her work in the field of molecular biology adheres to very high standards. Her advanced degrees proved that she is armed with the skills needed to continue attaining research results that benefit the United States.
2. The four recommendation letters that our client obtained from her peers supported our argument that she is a leader in the field. These experts confirmed the significance of her work in the advancement of the field, one of whom stated that “[Client’s] accomplishment of this goal ensures that the United States remains at the forefront of cancer research and gene therapy, and empowers U.S.-based pharmaceutical companies to design the necessary pharmaceuticals, since they are provided direct access to this information. In all honesty, it is a matter of national interest and I hope that this has been communicated effectively . . .”
3. We also documented our client’s 17 published articles that had gathered 124 citations at the time of filing. These figures represented the usefulness of our client’s research to various other researchers around the world who are also progressing the field of molecular biology.

As we were able to convince the USCIS that our client’s investigations on hematopoietic stem cell/cancer cell biology and gene therapy are essential to the advancement of the U.S. medical and pharmaceutical industries, our client received notification of case approval 8 months and 18 days after her case was filed. As the cherry on top of the cake, our client received her green card approval notice a month later. The reason for such a short processing time is because she chose to file her I-485 application while her EB-2 NIW petition was pending approval. This pushes the overall processing time for the green card to become shorter as the USCIS is able to start reviewing the I-485 application much sooner. We congratulate our client for obtaining a green card, and we wish her the best as she embarks on new beginnings in the United States.
