Success Stories: Delaware-based Postdoctoral Researcher in the Field of Polymer Science with Approved NIW Petition Receives Green Card

Client’s Testimonial:

“Thank you so much for your service. I have highly recommended several of my friends to apply green card through your firm.”

On April 27th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Polymer Science (Approval Notice).

General Field: Polymer Science

Position at the Time of Case Filing: Postdoctoral Researcher

Country of Origin: Taiwan

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Delaware

Approval Notice Date: April 27th, 2016

Processing Time: 1 month, 26 days

Case Summary:

A postdoctoral researcher from Taiwan needed North America Immigration Law Group’s help to compile and file a convincing EB-2 NIW (National Interest Waiver) petition on his behalf. Less than 2 months after we did so, the USCIS took action on his case by granting their approval. Our client, who has a doctorate in chemical engineering, has many years of experience conducting research in the field of polymer science and has attained many impactful findings as a result of his work. We were tasked with convincing the USCIS that he deserved the national interest waiver, and here is what we did to prove it:

  1. We listed our client’s 126 citations and his 8 publications. Using these numbers and additional evidence, we determined that not many other researchers who share our client’s background can produce such beneficial research results.
  2. Thanks to the comprehensive research summary that our client provided us, we were able to review and account for his various research ventures on designing, synthesizing, and characterizing novel polymeric materials for transport and conducting applications such as rechargeable lithium batteries. From what we gathered, we established that his work contributes to the commerce of the United States and to national environmental protection and energy efficiency, as his work provides superior materials that improve the transport and mechanical properties of industrial materials.
  3. We encouraged our client to collect recommendation letters signed by other influential researchers in the field. Four experts agreed to lend their support, one of whom described our client’s work as “…truly exceptional, and few experts, if any, are working as productively and efficiently as [Client], as evidenced by his publication and citation records as well as the scientific and commercial applications that his research boasts.” Another expert stated that “[Client’s] work directly facilitates the development of improved lithium batteries and nanotechnologies, and his work thus benefits a number of technology industries in the United States in ways that set him apart from his colleagues in the field.”

Filing an I-485 application while the I-140 petition is pending approval:

Our client retained our services to file I-485 applications for himself and his spouse (this is the final step in the green card process). Instead of waiting for his I-140 EB-2 NIW petition to be approved first, he chose to file his I-485 while the latter was pending approval. He recently received good news from the USCIS, and we join our client as he celebrates obtaining a highly sought-after green card.
