Success Stories: Despite a Long Waiting Time Period, An Engineer in the Field of Chemical Engineering Acquired NIW Approval Successfully Without RFE Issuance

Client’s Testimonial:

“I do appreciate the work and prompt reply from Wegreened.”

On June 7th, 2022, we received another EB-2 NIW (National Interest Waiver) approval for an Engineer II in the Field of Chemical Engineering (Approval Notice).

General Field: Chemical Engineering

Position at the Time of Case Filing: Engineer II

Country of Origin: China

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: June 7th, 2022

Processing Time: 17 months, 9 days

Case Summary:

Our NIW client from China is a Master of Science degree holder in chemical engineering. Based on his education and research background, he is currently employed as an Engineer II and approached us to help him in applying for a waiver of the job offer by filing an NIW (National Interest Waiver) petition on his behalf, demonstrating his proposed research on investigating downstream process development for biotherapeutic drugs to increase drug purity and yield through innovative purification methods. Since the EB2-NIW category of nonimmigrant visa is for those foreign nationals who can prove the worth of their research for the United States, we agreed to take our client’s case and laid out a strong NIW petition affirming the great importance his research holds to tangibly contribute to improved access to vital and affordable medications.

After going through his CV, transcripts, certificates, and letters of recommendation thoroughly, we found the noteworthy attributes to include in his petition package and some of them are as the following:

  • His research resulted in three peer-reviewed journal articles (one of them first-authored).
  • These publications have been cited a total of 86 times according to Google Scholar.
  • Furthermore, his study has received funding from 3 international organizations, namely the National Natural Science Foundation of China (NSFC) and the Tianjin Natural Science Foundation, and the National Science Foundation (NSF).
  • We also showed that his proposed endeavor has broad implications for public health and well-being in the United States. Among other applications, his work is relevant to reducing drug prices both domestically and abroad, thereby preserving capital and lives.
  • Moreover, we attached 4 letters of recommendation obtained by our client acquired from his fellow experts to further bolster his claim to the NIW category. One of the recommenders stated the below:

“While the [client] has accomplished much in the way of research, his accomplishments in the private sector are vital to global concerns. His current research is leading to significant developments in drug purification or the removal of unwanted components from biological drugs… His ongoing research is strengthening drug purity and yield, thereby enhancing economies of scale and reducing the financial burden of medical care. His unique background renders him distinctly capable of completing this research.”

We are glad that despite waiting for so long, our client finally was able to establish that his research is critical to human health, and in no place is this truer than the United States. Since half of Americans worry about healthcare costs and a third is already entrapped in significant medical debt, our client’s research mitigates the costliest aspect of drug production, promotes a more affordable drug process, and supports positive patient outcomes. Therefore, his NIW petition received approval, and we truly congratulate him on achieving this milestone. We wish him well in all his future endeavors.
