On March 9th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Research Assistant in the Field of Mechanical Engineering (Approval Notice).

Case Summary:

The USCIS spent 14.5 months adjudicating this EB-2 NIW (National Interest Waiver) petition before granting their approval. Our client, a postdoctoral research assistant working in the field of mechanical engineering, had suitable qualifications to file his I-140 petition under this visa category. There are two steps in the green card process: the I-140 petition and the I-485 application. As our client chose to file his I-485 application while his I-140 was pending approval, he received both approval notices roughly two months apart.

This case involved the following: case transference from one service center to another, two service requests, and the congressman approach. Despite everything, we are glad that the USCIS ultimately approved our client’s EB-2 NIW petition.

As with all our NIW cases, we helped our client narrow down a list of potential recommenders who could contribute recommendation letters. Our only requirement was that these recommenders be experts in our client’s area of study and that they were willing to attest to the significance of our client’s work to the field and to the United States as a whole. Our client managed to obtain five strong letters which we included in our comprehensive NIW petition dossier. One of these letters stated, “[Client] has shown an exemplary level of dedication and creativity. As a result, he has already provided the field of mechanical engineering with important insights, which in turn has given him recognition over his peers.”

We also included details on our client’s research findings on the mechanical properties of single-walled carbon nanotubes, along with data on his half a dozen publications and the 26 citations to his work. We expanded on what we learned and demonstrated to the USCIS that our client’s research efforts directly contribute to the country’s economy and that not many other mechanical engineers can mirror his success.

Overall, it may not have been an easy journey to green card success but we are pleased that we finally made it to the finish line.
