Case Summary:

A Malaysia-based postdoctoral fellow from Iran hired North America Immigration Law Group (WeGreened.com) to help him with the first step of the green card process: the I-140 petition. After carefully reviewing his credentials, we concluded that the most straightforward way to attain petition approval would be to file it under the EB-2 NIW (National Interest Waiver) visa category.

It took us several months to compile all the information that we needed to build a strong EB-2 NIW case. By the time we were ready to file our client’s petition, we had copious proof of our client’s high standing in the field of energy engineering. Immigrant Visa Processing:

After obtaining an I-140 petition approval, green card applicants have two options to attain permanent residency. If they are residing in the United States, they have to file an I-485 application. However if they are residing abroad, they need to obtain an immigrant visa. As our client is based in Malaysia, he has to undergo the latter. Among other things, this involves paying the relevant fees, making an appointment at the American consulate or embassy, and attending an interview there. Assuming everything goes according to plan, our client will receive an immigrant visa and using that, can enter the United States with his dependent(s) as official permanent residents. Their green cards will then be mailed to their American address.
