Success Stories: NIW Petition Approval for Assistant Professor from Iran Allows Her to Undergo Immigrant Visa Processing

Client’s Testimonial:

“Thanks a zillion for guiding me [through] this dreadful step. Unquestionably, I could not be successful if I had not consulted you.”

On March 4th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for an Assistant Professor in the Field of Clinical Epidemiology (Approval Notice).

General Field: Clinical Epidemiology

Position at the Time of Case Filing: Assistant Professor

Country of Origin: Iran

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: N/A

Approval Notice Date: March 4th, 2016

Processing Time: 8 months, 13 days

Case Summary:

An assistant professor working in the field of clinical epidemiology hired North America Immigration Law Group (WeGreened.com) to file an I-140 petition under the EB-2 NIW (National Interest Waiver) visa category. Despite the Request for Evidence that the USCIS issued (which we responded to promptly and efficiently), they only spent a little over eight months adjudicating the petition before granting their approval. Our client is now more than halfway through the green card process.

The Long Road to EB-2 NIW Approval:

As skilled as our team is at putting together strong NIW petitions, every case is different. No matter what, there is no denying that plenty of attention to detail must be paid to every presentation. We offered our client top quality counsel and did everything we could to put together a strong EB-2 NIW case. Here is part of what the petition contained:

  1. Scholarly Evidence: Our client’s M.D. proved that she possessed the knowledge and skills needed to carry out high quality medical research in the complex field of clinical epidemiology.
  2. Research Results: Her work has significantly contributed to the improvement of medical care and its availability. For instance, her research on the risk factors and prevalence rates of various diseases and medical issues allows for the development of novel advanced medical care techniques in the United States.
  3. Professional Credentials: We demonstrated the significance of our client’s research to other medical experts in the field by highlighting the 99 citations to her work, her two dozen published papers, and the 107 times she conducted peer reviews for high impact international journals.
  4. Recommendations: Favorable third party opinions paved the way for case approval. We incorporated five recommendation letters provided by other influential clinical epidemiologists, all of whom confirmed that our client’s work is of great value to the field. One of these experts stated that “Due to her incredible accomplishments in pushing forth new public health guidelines, I can look ahead to her undoubted next innovations, which ultimately help shape the US health collective.”

Immigrant Visa Processing:

Because our client resides outside the United States, she is not eligible to file an I-485 application (final step in the green card process) and instead, has to undergo Immigrant Visa Processing at an American consulate or embassy. Upon approval of our client’s I-140, her case was forwarded to the National Visa Center (NVC). Our client had to pay the filing fees and submit the relevant paperwork in order to get her case forwarded to the relevant U.S. embassy or consulate. Assuming our client does well at the scheduled interview appointment, she will receive her immigrant visa stamp, which allows her and her dependents to enter the United States as permanent residents. We wish her the best with this and look forward to welcoming her into the country as an official green card holder.
