On March 8th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Research Associate in the Field of Bioengineering (Approval Notice).

General Field: Bioengineering

Position at the Time of Case Filing: Postdoctoral Research Associate

Country of Origin: Iran

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: March 8th, 2016

Processing Time: 11 months, 6 days

Case Summary:

A postdoctoral research associate from Iran hired North America Immigration Law Group (WeGreened.com) to help him attain a green card. His doctoral degree and extensive experience working in the field of bioengineering made him a suitable candidate for EB-2 NIW (National Interest Waiver).

Petition Presentation:

Our job was to demonstrate to the USCIS that our client’s work is significant to the United States and that his presence in the country is mandatory to the advancement of the field of bioengineering. We started off by urging our client to ask other experts in his field for recommendation letters. The five letters that he managed to obtain were included in our well-balanced EB-2 NIW presentation. We used these letters to verify our client’s various professional accomplishments. Here are several examples:

  • “Without [Client’s] continued research, American efforts to combat cancer (as well as any other disease that spreads organically within the human body) would lose a vital resource in the search to understand how to program and design delivery agents with the greatest efficiency at the micro/nanoscopic level.”

This quote demonstrated the importance of our client’s development of new micro-and nano-technologies capable of improving the treatment of patients afflicted with cancer and a variety of other deadly diseases.

  • “[Client] has built himself a profound reputation based upon his […] findings. Publication of his research and conclusions in the highly-esteemed journals […] has allowed […] to enter into the bioengineering mainstream…”

When we filed our NIW petition, our client’s work had attained 63 citations and information gleaned from his 8 published papers had significantly advanced the work of other researchers in the field.

  • “In summary, [Client] is an outstanding scientist who has developed economically important technologies. I fully support [Client’s] petition to advance this work and his career in the United States.”

We established that our client’s research addresses the United States’ need for new therapeutic and diagnostic tools in medical procedures and treatments. Our petition proved that his efforts contribute to the nation’s ongoing struggle to find a cure for cancer.

Final Step:

The USCIS look longer than expected to adjudicate our NIW petition. We raised a service request on our client’s behalf when the average processing time went beyond the norm. Overall, our client waited a little over 11 months to receive an approval notice from Texas Service Center. We are pleased that they ultimately granted their approval. We recently helped our client file an I-485 application (last step in the green card process), and are currently helping him respond to a Request for Evidence (RFE) notice issued by the USCIS. We look forward to reaching the approaching green card finish line with our client.
