On April 14th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Product Development Engineer in the Field of Optical Engineering (Approval Notice).

Almost 8.5 months after we filed an EB-2 NIW (National Interest Waiver) petition on our client’s behalf, Texas Service Center granted their approval. Our client, a gifted product development engineer from China, hired us to put together and submit a strong NIW petition for him, which we did in an efficient and effective manner.
Our main task was to prove that our client’s design and fabrication of novel biosensing systems capable of detecting and monitoring moisture or chemical residues are original and beneficial to the United States. Based on the research summary that our client sent us, we were able to conclude that his research addresses the need for improved screening methods for protecting the medicines and sources of sustenance that are instrumental for human survival. Referencing our client’s citation and publication record (32 and 5 respectively), we determined that not many other researchers working in the field of optical engineering can replace our client should his work in the U.S. be interrupted.
Our client’s EB-2 NIW petition also contained information pertaining to the 20 reviews that he conducted for high impact scientific journals. We used this achievement to prove to the USCIS that our client’s insights are highly regarded by other researchers. According to a well-known professor working in the field, “[Client] is a remarkably prolific and important optical engineer, and his work has truly been groundbreaking. […] Were [Client] not able to continue his work in the United States, I know of no other engineer who could carry on his progress in optical sensors as prolifically and profitably as he has done.” This quote is extracted from the recommendation letter that he provided in support of our client’s EB-2 NIW petition. He was not alone in this show of support, and was joined by five other expert optical engineers. These letters served as important evidence that our client’s work is valued by various researchers and that he is a respected member of the field.
Overall, we raised one service request on our client’s behalf when the case was considered outside the normal processing time. This allowed him to focus on his important research. We are pleased that the USCIS ultimately decided to approve our client’s EB-2 NIW petition, and we look forward to helping him file an I-485 application once his priority date becomes current. In the meantime, we wish him the best with his continued research.
