Case Summary:

Based on the huge number of successful cases, North America Immigration Law Group has developed the most up-to-date winning strategies for the NIW category, which enable us to offer our “Approval or Refund” services to many of the NIW cases we take. However, there are certain prerequisites to be fulfilled by an individual including:

  • The foreign national must be in a position to advance the proposed endeavor.
  • The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2.
  • A proposed endeavor, holding substantial merit and national importance.
Our client, a Neurology Resident from Colombia, approached us to file NIW (National Interest Waiver Petition) on her behalf.

She has completed her MD and as an expert in the field of neurology, her proposed endeavor is to perform and interpret diagnostic testing to better understand different mechanisms and risk factors involved in epilepsy to reduce or eliminate seizures in patients, ultimately improving their quality of life. Therefore, to make a persuasive case in her favor, we included the following details in her petition packet:

  • Her work has resulted in 9 peer-reviewed journal articles (4 of them first-authored).
  • Her publications have been cited a total of 149 times according to Google Scholar.
She has even received 4 recommendation letters from her fellow experts in the field, one of whom remarked:

“...Far more research and resources are needed to bring better treatment to these patients, who count for nearly half of all epilepsy cases worldwide. [Client’s] research directly addresses these concerns to achieve better treatments for patients with epilepsy symptoms.”

In consequence, she proposes to continue her research on performing and interpreting diagnostic testing to better understand different mechanisms and risk factors involved in epilepsy too to reduce or eliminate seizures in patients with intractable epilepsy, ultimately improving their quality of life, which is an endeavor with substantial merit and national importance.

On that account, she received her NIW approval despite waiting for a more extended period. She has even retained our firm for her I-485 case, which is currently under active status. We are pleased to have been a part of her success story and would like to wish her good luck in her upcoming endeavors.
