On May 4th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Research Scientist in the Field of Biosystems Engineering (Approval Notice).

General Field: Biosystems Engineering

Position at the Time of Case Filing: Research Scientist

Country of Origin: Nepal

State of Residence at the Time of Filing: South Dakota

Approval Notice Date: May 4th, 2021

Processing Time: 8 months

Case Summary:

Armed with a Ph.D. in biosystems engineering, a research scientist from Nepal contracted with North America Immigration Law Group to represent his I-140 NIW (National Interest Waiver) petition. Our client exhibited progressive research work that persuaded many of his fellow engineer scientists in the field. He had a remarkable record of 74 citations from his 6 peer-reviewed journal articles (4 of them first-authored) and 2 technical reports (1 of them first-authored). Moreover, he is very active in the scientific community of the field as a peer reviewer and judged the work of others 23 times, indicating his elevated standing in the field. Thus, his education and training, his documented record of scholarly publication, and the recognized influence of his research in the field demonstrate that he is well-positioned to advance his work in the United States.

Our law firm is well recognized for the fact that we go beyond for our clients to achieve their green cards, and we help them step by step to move closer to achieving the same. When our client approached for his NIW case preparation, we asked him to provide us with the relevant paperwork and started devising his case in the best possible manner. We established his research on utilizing remote sensing and hydrological modeling to monitor critical water resource information to elucidate efficient and sustainable water management practices. We deduced that his intended endeavor seems to be relevant to the problems related to water scarcity and management as well as improved agricultural practices.

It was our main objective to prove to the USCIS that his research is of great importance in the United States because it supports water resource sustainability and efficiency, particularly as related to agriculture and other human activity. In further evidence, we noted that our client’s work has been supported with funding grants from the National Aeronautics and Space Administration (NASA)’s Terrestrial Ecology Programs. This funding support from NASA’s Terrestrial Ecology Program, which enable research that uses space-based observations (remote sensing) to better comprehend Earth’s carbon cycle and ecosystems, therefore, demonstrates the significance and national importance of his research.

Furthermore, we added 5 recommendation letters he obtained from other well-known researchers in the field, proving how our client’s research was a valuable resource for guiding their studies, and he must continue contributing to the interests of the United States. According to one of his recommenders:

“[Client’s] research examining the effects of these drainage methods on evapotranspiration (ET) rates improves general understanding of hydrological systems and supports crop output in the US. As a result, his hydrology-based work is highly advantageous to the US economy, as it helps improve agricultural procedures and policies.”

Fortunately, USCIS was persuaded with our presentation of our client’s NIW case, displaying all the evidence that his research holds significant value for addressing growing water scarcity in the U.S. through improved water policies. Therefore, he was granted the petition approval hassle-free. We truly thank him for choosing our law firm and cooperating with the team members throughout the process. We wish him good luck in his future endeavors.
