Case Summary:

In this EB-2 NIW (National Interest Waiver) case, a clinical psychologist and CEO approached North America Immigration Law Group to help him navigate the complex green card process. After we filed the case, it took over eight months before we received an approval notice from NSC. The lengthened timeframe had to do with the Request for Evidence (RFE) that the USCIS issued. We responded to the RFE to the best of our abilities and successfully convinced the USCIS that our client’s qualifications are legitimate and that he is an asset to the United States.

Client’s Qualifications:

In order to qualify for the national interest waiver, one must possess certain qualifications. In this case, our client’s educational and professional background made him suitable to file his case under EB-2 NIW. Our well-balanced petition packet contained a copy of his Ph.D. and his transcripts, and we also highlighted the nearly 75 citations to his work and his various publications (journal articles, books/book chapters, government reports, and numerous conference papers). Our petition letter also contained descriptions of our client’s research projects on identifying and treating people suffering from the disorders and distresses of suicidal ideation, post-traumatic stress disorder (PTSD), and borderline personality disorder. We also illustrated our client’s efforts to educate the public on these issues and offer evidence for those who suffer from these issues in legal cases. We convinced the USCIS that our client’s work directly contributes to the dissemination of knowledge about these psychological maladies, and that it is of great value to the United States.

Third-party Support:

We helped our client narrow down a list of potential recommenders who could support our EB-2 NIW petition. We urged our client to contact five of these recommenders for testimonials, all of whom obliged. One of them wrote, “His past record of helping those with mental, emotional, and behavioral disorders suggests there is more to expect from [Client] in this area in his future.”

Another letter stated, “In the United States, military veterans, survivors of violence, and a host of others struggle to cope with the aftereffects of traumas long since passed. Immigrant Visa Processing:

The moment out client’s I-140 was approved, he qualified for Immigrant Visa Processing (IVP): IVP is the final step in the green card process for applicants residing outside the United States. Once our client’s IVP is approved, he and his dependents can enter the United States as permanent residents. We wish our client the very best.
