Success Stories: NIW Petition Approved for Postdoctoral Research Associate from Nepal in the Field of Nanoscience

Client’s Testimonial:

“Thank you very much for your help in preparing the documents for EB2 NIW applications. I have already recommended you 3 others and will recommend to others also in future. Thank you very much for outstanding service of your group.”

On May 2nd, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Research Associate in the Field of Nanoscience (Approval Notice).

General Field: Nanoscience

Position at the Time of Case Filing: Postdoctoral Research Associate

Country of Origin: Nepal

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Iowa

Approval Notice Date: May 2nd, 2016

Processing Time: 8 months, 8 days

Case Summary:

Last year, a postdoctoral research associate from Nepal engaged the services of North America Immigration Law Group (WeGreened.com) to file an EB-2 NIW (National Interest Waiver) petition for him. After carefully reviewing his credentials, we confirmed that EB-2 NIW was the most straightforward way for our client to get one step closer to his green card. After an attorney-client relationship was established, we starting compiling a wealth of information related to his professional performance as an active member of the nanoscience research community.

Proving that our client deserves the national interest waiver:

Our job was to convince the USCIS that our client’s research efforts are valuable to the nation and that his findings are essential to the progress of the U.S. as a whole. We thoroughly accounted for our client’s research on the synthesis and characterization of nanomaterials and established that his ventures have directly contributed to the development of more advanced nanomaterial-based technologies, which are becoming increasingly ubiquitous. Additionally, his nanoparticle research contributes to the American electronics, biomedical, and energy sectors.

“With this project, nanotechnology went from a study of uncontrolled synthesis, which most researchers agreed was not conducive to its application at the industrial level, to one of controlled synthesis, making this area of science extremely useful to the biotech, catalysis, and solar power industries. In this way, [Client’s] work has displayed its own intrinsic worth, and shown him to be a scientist advancing this new technology into a less theoretical and more practical realm for both now and long into the future.”

The statement above was made by one of our client’s five selected recommenders. Each of them signed strong recommendation letters that verified the importance of our client’s research efforts on multiple levels. To bolster their claims, we included data on our client’s citation count and publication record at the time of filing. These numbers stood at 119 citations and 13 articles, a book chapter, and numerous conference papers. We also noted his doctorate in physics and determined that he is well-equipped with the theoretical knowledge to conduct beneficial research.

Taking one step at a time:

It took us several months to prepare our client’s EB-2 NIW petition packet and overall, Nebraska Service Center spent 8 months and 8 days adjudicating it before granting their approval. Although we had to raise a service request on our client’s behalf when the case was considered outside the normal processing time, everything worked out according to plan and our client is now much closer to green card success. We congratulate him on this and wish him the best with his I-485 application (adjusting his status for permanent residence).
