Case Summary:

A postdoctoral research associate from Sri Lanka hired North America Immigration Law Group (NALG) to help her and her spouse obtain their green cards. There are two steps in the green card process: filing an I-140 petition followed by the I-485 application(s). In this case, we filed an EB-2 NIW (National Interest Waiver) petition based on our client’s credentials, and at the time of writing, started work on her and her spouse’s I-485 applications (he is considered a derivative beneficiary of her I-140 petition).

In preparing our client’s NIW petition, these are some of the main points we chose to focus on based on the Matter of Dhanasar guidelines implemented by the USCIS

  • We noted her doctoral degree and the 7 publications to her name.
  • The 34 times her work was cited by independent and dependent researchers were also listed.
  • We also reviewed and summarized our client’s work on inventing and understanding the nature of Iridium-Bismuth (IrBi) metal complexes, as well as expanding the fundamental understanding of how bimetallic systems bond, function and give rise to industrially important catalytic properties. We concluded that she is one of only a small handful of researchers who can conduct such impactful research, and whose findings greatly benefit the United States.
  • To further strengthen our client’s NIW petition, we also included recommendation letters signed by other experts working in the field. According to one of them: “Her work so far has addressed fundamental questions of industrial chemistry and, considering her history of success, her future research is certain to make further progress in this area.”

We are pleased that our meticulous efforts paved the way for case approval. We thank our client for working with us and look forward to helping her and her spouse obtain their green cards.
