Case Summary:

North America Immigration Law Group filed an EB-2 NIW (National Interest Waiver) petition on behalf of a research scientist from Taiwan. Our client, who holds an M.S. and a Ph.D., conducts research in the field of molecular biology. Her work focuses on mechanisms responsible for processes ranging from immune response regulation to detecting circulating tumor cells.

By proving that our client had created an unique technology of immense value in oncological research, developed an diagnostics tool using ribonucleic detection, and had reported, for the first time, on the use of miRNAs in regulating TLRs and cytokine signaling, we established that her work is essential to the progress of the United States’ healthcare system. Our detailed petition dossier also summarized her professional record, notably the nearly 2000 citations her 7 publications had collected. We also included testimonials contributed by experts in her field. One of these letters stated that “[Client] has become a prominent member of a field that is vital to the public health, thereby placing herself in an important and influential position. I can say without a doubt that allowing [Client] to continue conducting her research in the United States is instrumental in ensuring that the country remains in the forefront of oncological treatment research and development.”

Despite our client’s outstanding credentials, the USCIS took longer than usual to adjudicate her case. We raised a service request seven months after we filed the I-140; in response, the USCIS issued a Request for Evidence (RFE). We efficiently responded to the RFE and, three months later, our client received the good news that her EB-2 NIW petition had been approved. We join our client in celebrating this milestone and wish her all the best in the remainder of her green card journey.
