Case Summary:

Less than 9 months after we filed an EB-2 NIW (National Interest Waiver) petition for an Iranian senior research associate, the USCIS granted their approval. With extensive experience working in the field of biomedical informatics and a doctoral degree, our client had strong credentials to file his I-140 petition (first step in the two-part green card process) under EB-2 NIW. Here’s what we included in his petition packet to prove that he met the requirements set by the USCIS to qualify for the national interest waiver:

  1. With the help of Google Scholar, we noted that our client’s work had gathered 57 citations at the time of filing. We also noted his 4 published scientific articles, all of which appeared in high impact journals. Alongside his citation and publication record stood his peer review experience (he had conducted peer reviews for 5 scientific periodicals when we filed his EB-2 NIW petition).
  2. We also included a copy of our client’s Ph.D. in Biomedical Informatics and its corresponding transcripts—we wanted to prove to the USCIS that our client is equipped with the theoretical knowledge to conduct outstanding fieldwork.
  3. Our client’s peers contributed expert testimonials, and we included these five letters into his petition dossier. His recommenders were made up of three professors, a staff scientist, and a project director, all of whom contributed strong recommendation letters that contained statements such as these:

“In summary, [Client] is conducting cutting-edge scientific and engineering research that is beneficial to academic and medical based communities. His skill set and contributions are extremely difficult to replace, and establish him as an integral member of the United States electrical engineering community”

“[Client] has quickly risen to the forefront of his chosen field, due in no small part to his significant expertise in the applications of electrical engineering to security and medical concerns. This has made him particularly well-suited to addressing contemporary challenges in diagnostic tools, including our ability to identify common and life threating health concerns”

North America Immigration Law Group (WeGreened.com) was able to prove that our client’s work on the use of automated computational tools in the medical industry improves the ability of professionals working in the healthcare sector to diagnose diseases. Although the USCIS eventually approved our client’s NIW petition, it took them a long time to do so and we had to raise a service request on our client’s behalf after the case was considered outside the normal processing time. We congratulate our client for obtaining a highly sought-after EB-2 NIW petition approval, and wish him the best with his continued research ventures.
