Case Summary:

Texas Service Center spent a little over four months adjudicating this EB-2 NIW (National Interest Waiver) case. A month later, we received a Request for Evidence (RFE) from the USCIS, which we promptly responded to. After we submitted our response to the RFE, we waited more than 60 days before we contacted the USCIS once more with a service request, which they responded to by informing us that they were performing additional reviews on the case. Two months later, we suggested that our client contact her local congressperson for assistance regarding the status of her case. The day our client received a reply from her congressperson informing her that her I-140 was being reviewed, the USCIS granted their approval.

Besides dealing with the USCIS, we were also responsible for putting together a strong EB-2 NIW petition packet to highlight our client’s various professional accomplishments and capabilities. Our petition packet was composed of our client’s citation and publication record (67 and 6 respectively), and carefully worded details on her research efforts on gene and stem cell based therapies for cancer, cancer targeted chemotherapy, and nanotechnology in medicine. We demonstrated that our client’s work benefits public health in the United States and that not many other researchers can attain similar meritorious results. Furthermore, our NIW petition packet included several recommendation letters furnished by other experts in the field of nanomedicine. These letters served as additional evidence of the value of our client’s work to the Unites States, as exemplified by the following statement excerpted from one of the letters: “In conclusion, through her research and hard work, [Client] has already had an impact on cancer treatment and the application of nanotechnology and nanoparticle construction to medicine. The issues that her research deals with directly impacts the United States because of the high affliction rate of cancer throughout the American population.”
