Success Stories: NIW Petition Approved in 8.5 months for Researcher in Michigan in the Field of Nanotechnology
Client’s Testimonial:
“Thank you so much. You did tremendous job to make it happen. Thanks again for suggestions, support, passion and everything you did while preparing/submitting I-140 petition packet.”
On September 1st, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Researcher in the Field of Nanotechnology (Approval Notice).
General Field: Nanotechnology
Position at the Time of Case Filing: Researcher
Country of Origin: Nepal
Service Center: Nebraska Service Center (NSC)
State of Residence at the Time of Filing: Michigan
Approval Notice Date: September 1st, 2016
Processing Time: 8 month 16 days
Case Summary:
With a Ph.D. in Condensed Matter Physics and over 4 years of experience conducting research in the field of nanotechnology, our client (a researcher from Nepal) seemed like a great candidate for EB-2 NIW (National Interest Waiver). After thoroughly evaluating his credentials, we concluded that he qualified for the national interest waiver and we subsequently went about building a strong case for him.
Deciding what to include in the petition:
Part of North America Immigration Law Group’s job entailed selecting relevant information to include in our client’s EB-2 NIW petition. We wanted to be sure that the USCIS could clearly see that his work is essential to the United States and that not many other similarly qualified researchers can obtain such praiseworthy research results. For one, we highlighted the half a dozen publications to his name and the over 200 citations his work had gathered. Furthermore, we supported his case by including recommendation letters provided by other experts working in the field of nanotechnology. According to one of these experts, our client’s work “…provides the cornerstone for current and ongoing scientific inquiry.” This recommender went on to state that “Based on [Client’s] demonstrated value to the economy and American industry, halting his work would be detrimental to electronic development and manufacturing throughout the country.”
Highlighting our client’s research:
The most important element of our client’s EB-2 NIW petition is arguably the information we included on his research regarding nano-electronics and their engineering. We demonstrated that our client’s work directly contributes to the understanding of flexible electronics and optoelectronics, which benefits American nanotechnology industries and solar harvesting efforts. Additionally, his research outcome of layered transition metal dichalcogenides (TMDs) is contributing to the United States’ energy independence efforts, electronic manufacturing, and economic outlook. We have no doubt that our meticulous presentation of the various benefits that our client’s work has on the US paved the way for case approval.
Securing petition approval:
After 8.5 months, the USCIS finally decided to approve our client’s EB-2 NIW petition. We congratulate him on this milestone and wish him the best as he adjusts his status for permanent residence by filing an I-485 application.
