Success Stories: NIW Petition Approved Second Time Around for Nepalese Postdoctoral Fellow in the Field of Materials Science

Client’s Testimonial:

“I would like to thank the I-140 team. They are special to me since they have worked [on] my I-140 twice. As I mentioned in my previous email, I have always recommended your law firm and I will be doing so continuously […] Thank you again for your work…”

On February 17th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Materials Science (Approval Notice).

General Field: Materials Science

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: Nepal

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Texas

Approval Notice Date: February 17th, 2016

Processing Time: 8 months, 30 days

Case Summary:

We are pleased to congratulate our client on not only getting his EB-2 NIW (National Interest Waiver) petition approved, but also his I-485 application. He and his family are now proud American permanent residents, and North America Immigration Law Group is delighted to have been a part of their journey. This is not our client’s first try at a green card. His first NIW petition was denied but that did not stop him from trying again. This time around, he opted to file his I-140 and I-485 concurrently, which resulted in an approval notice almost nine months later.

Petition Details:

Our winning EB-2 NIW petition packet was filled with information on our client’s many accomplishments. We detailed his Ph.D. in Physics and the many research projects that he has carried out. We also documented the 170 citations gathered from his 17 publications and conference presentations, and highlighted the peer reviews he conducted for five scientific journals. Most importantly, we meticulously presented his research on scintillating materials for high energy (Gamma, X-ray) applications, ceramic laser technologies, and nanoparticle-assisted deep tissue medical imaging techniques. We convinced the USCIS this postdoctoral fellow is carrying out research that is of intrinsic merit to the United States, most notably to the country’s medical sector. We also demonstrated that only a scant handful of materials scientists can mirror our client’s copious professional accomplishments.

Strong Recommendations:

In preparing the NIW petition, we also counseled our client to touch base with other experts in his field and ask them for recommendation letters. Seven experts furnished us with testimonials, all of which were included in our comprehensive petition packet. One of these letters stated, in part, that “There is no doubt in my mind [Client’s] biophotonics advancements will continue to fundamentally inform the field’s development of new biomedical imaging technology, since his research has already done so for years.”

We are glad that we were of service to our client, and we congratulate him once more for successfully obtaining green cards for himself and his family. We wish him all the best with his continued research ventures.
