On June 10th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Senior Research Fellow in the Field of Molecular Biology (Approval Notice).

Case Summary:

With a Ph.D. in Molecular Genetics and many years of experience carrying out studies in the field of molecular biology, our client (a senior research fellow form Iraq) seemed like a good fit for I-140 EB-2 NIW (National Interest Waiver).

Leaving no stone unturned, we gathered an array of information pertaining to our client’s work on the early detection and treatment of viral infections. Our goal was to convince the USCIS of the following:

  • Our client’s work has both substantial merit and national importance;
  • Our client is well positioned to advance the field of molecular biology;
  • On balance, it would be beneficial to the United States to waive the job offer and labor certification requirements.

Besides hard evidence of the significance of our client’s work (such as the 322 citations gathered from his 37 publications), we also incorporated subjective evidence into the NIW petition dossier. This took the form of recommendation letters signed by other expert molecular biologists. According to one of them, our client’s research “has had a great influence on other researchers.” Another expert stated that “[Client] has the talent needed to continue to make groundbreaking contributions into the foreseeable future.”

After months of hard work, we filed a strong EB-2 NIW petition on our client’s behalf. Less than 4 months later, our client received notification of case approval. We congratulate our client for securing the national interest waiver.

Taking the final step:

There are two steps in the green card process: (1) filing an I-140 petition and (2) filing an I-485 application or undergoing immigrant visa processing (IVP). In this case, our client does not live in the US and therefore must undergo IVP in his country of residence.
