Case Summary:

A postdoctoral fellow from Denmark recently received the good news that his EB-2 NIW (National Interest Waiver) petition had been approved. The USCIS spent a little over eight months adjudicating our client’s petition before deciding that he deserved to get one step closer to his green card. Now all our client has to do to attain permanent residency is file an I-485 application and await a favorable response from the USCIS.

When our client first approached us, he wanted us to evaluate his chances with both EB-2 NIW and EB-1A (Alien of Extraordinary Ability). After carefully reviewing his credentials, we determined that the best course of action would be to go with EB-2 NIW. After an attorney-client relationship was established, we immediately got to work assembling a strong NIW petition on his behalf. Here were some of the things we focused on:

  1. We detailed our client’s M.S. in Physics and Nanotechnology and Ph.D. in Physics, Chemistry, and Informatics, and demonstrated that his advanced degrees have helped him obtain the knowledge and skillsets needed to carry out high impact research in the field of computational science.
  2. Our client’s professional record was partly composed of the 110 citations to his work and his 3 published scientific articles.
  3. As part of our services, we thoroughly reviewed his research ventures on the application and development of machine learning techniques for modeling chemistry. Using what we gathered, we determined that his efforts contribute to the United States research community as well as provide new tools for use in industries that rely on chemical processes, including industries in the energy sector.
  4. Our client was tasked with asking other experts in his field for recommendation letters. We helped him select whom to contact, and he returned with five strong testimonials, all of which confirmed the value of his research to the United States. Here is what one of his recommenders had to say about him: “[Client] has a very advanced skillset at his command, encompassing multifarious aspects of density functional theory, condensed matter physics, and other specialized computational methods and related subfields. This knowledge base, both broad and deep, has served him well in his research career.”
Petition Approval:

We are pleased that our well-prepared presentation of our client’s strong credentials paved the way for case approval. We congratulate our client on this milestone and wish him the best with his continued investigations..
