Case Summary:

A prominent director of software technology from Vietnam hired North America Immigration Law Group (WeGreened.com) to file an EB-2 NIW (National Interest Waiver) petition on his behalf. Because our client is currently based outside the United States, he has to apply for an immigrant visa at an American embassy or consulate before receiving his green card. Once our client and his dependents are granted immigrant visas, they may enter the United States as permanent residents. This process is known as Immigrant Visa Processing (IVP) and is the final step in the green card process for applicants residing outside the United States.

Although the second and final step may differ for applicants outside the U.S., the first step remains the same for everyone (the I-140 petition). In this case, our client qualified to file his I-140 petition under the EB-2 NIW visa category. Our legal team was tasked with putting together a strong petition packet that highlighted our client’s various academic and professional achievements. Here are several of the main points that we included in our well-thought-out NIW presentation:

1. Recommendation Letters: We urged our client to gather recommendation letters from other experts in his field of computer engineering. He managed to obtain four letters, all of which strongly advocated the value of his work to the United States. For instance, one of his recommenders wrote, “Without [Client’s] presence in the field, the research community of the United States will be at a considerable disadvantage, as [Client’s] innovations have led to tangible improvements in evolutionary computational research.”

2. Citation & Publication Count: Our client had 9 published papers to his name and at the time of filing, his work had amassed nearly 350 citations. These figures illustrate the value of our client’s work to other researchers in the field, who are using his findings to advance their own research.

3. Educational Background: Our client has a Ph.D. in Computer Engineering from a top university in Singapore. We included a copy of his degree and its corresponding transcripts to prove to the USCIS that our client is equipped with the knowledge and skills to carry out topnotch research.

4. Research Efforts: We wanted to present a strong NIW case to the USCIS and in order to do that, we had to review our client’s research ventures on memetic algorithms and memetic algorithm packages aimed at improving the process and outcome optimization in a range of computational contexts. Based on what we gathered, we demonstrated to the USCIS that our client’s investigations directly contribute to the booming American high technology sector.
