Client’s Testimonial:

"Thanks for the help throughout the process.”

On March 16th, 2026, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Research Fellow in the Field of Cancer Immunology (Approval Notice).

General Field: Cancer Immunology

Position at the Time of Case Filing: Postdoctoral Research Fellow

Country of Origin: British National Overseas

State of Residence at the Time of Filing: Washington

Approval Notice Date: March 16th, 2026

Processing Time: 3 months, 18 days

Case Summary:

Solid tumors remain one of the most difficult frontiers in cancer treatment, largely because the tumor microenvironment actively suppresses the immune response and limits the effectiveness of checkpoint therapies. The client is a postdoctoral research fellow specializing in cancer immunology, with a research focus on developing new treatment strategies for solid tumors.

North America Immigration Law Group (Chen Immigration Law Associates) approached this filing with a case-by-case strategy, carefully analyzing the client’s background to identify the strongest arguments under the NIW framework. Rather than simply listing credentials, we built a cohesive narrative around three core arguments: the substantial merit and urgency of the researcher’s proposed endeavor, the client’s demonstrated ability to advance that endeavor based on a documented record of impact, and the broader national benefit of waiving the job offer requirement to allow the research to continue without unnecessary delay.

A key part of our strategy was framing the national importance argument around the real-world consequences of the client’s research. We demonstrated that advancing the effectiveness of immunotherapy for solid cancers directly addresses a critical public health need in the United States, and that the client’s independent, institution-spanning approach to research amplifies the breadth of its potential impact across academia, industry, and government.

We organized the supporting evidence to give USCIS a clear and verifiable picture of the client’s expertise and influence:

  • Publication record: 9 peer-reviewed journal articles (3 of them first-authored) and 10 conference abstracts (7 of them first-authored)
  • Scientific influence: 716 citations, with multiple papers ranked among the most-cited in their category and year of publication
  • Peer review service: Invited to review for an authoritative journal in the field, reflecting recognition by the academic community as a subject-matter expert
  • Education: Ph.D. in biological and environmental engineering

We also argued that the labor certification process would be impractical in this case. The expert’s highly specialized expertise substantially exceeds the minimum occupational requirements that labor certification is designed to assess, and requiring such a process would impose delays inconsistent with the dynamic, collaborative nature of frontier biomedical research.

USCIS approved the NIW petition in just over 3 months without an RFE. We are proud to have supported the client throughout this journey and look forward to seeing the continued impact of their work in advancing cancer immunology in the United States.
