Success Story: EB-2 NIW (National Interest Waiver) Approval for Pharmacist without a PhD

EB-2 NIW (National Interest Waiver) Approval for Pharmacist without PhD” (Approval Notice)

Case Summary:

On 12/05/2012, we at Chen Immigration Law Associates received approval of an EB-2 NIW advanced degree professional for a client who is working as a Pharmacist but used to be pharmaceutical researcher. We presented our clients as an expert of the development of several new generic drug formulations, as well as the determination of proper drug administration and dosage for various commonly used drugs.

Before the client retained us, he was really worried that he might have a weak case, due to the fact that he only possessed a Master’s degree and had not completed any research for several years. Although the client did not have a particularly strong history of publication or citation, we were able to emphasize the significance of his contributions to the field of pharmaceutical research, as well as to the United States as a whole.

To strengthen his case, we drafted six strong recommendation letters in which we emphasized the significance of his past contributions to both the field of pharmaceutical research. Using our unique and highly successful strategies, we were able to present our client’s research accomplishments and future employment as a direct benefit to healthcare in the United States. Despite the fact that he was not currently employed in a research position, the USCIS recognized the merits of our client’s past research contributions and swiftly approved the petition without Request for Further Evidence (RFE).
