The widespread underdiagnosis of sleep disorders creates a serious public health challenge, particularly because untreated sleep conditions can contribute to cardiovascular disease, diabetes, mental health complications, reduced productivity, and avoidable healthcare costs. In this I-140 NIW case, North America Immigration Law Group presented the client’s work in internal medicine as a nationally important effort to improve early detection, treatment accessibility, and clinical understanding of sleep-related health complications.

 

The client’s proposed endeavor was to continue research on developing advanced diagnostic tools, conducting clinical research, and implementing innovative treatment strategies to address underdiagnosed sleep disorders and clarify their broader impact on overall health. At the time of filing, the client was employed as a resident physician and had secured an upcoming fellow physician position, where the client planned to continue evaluating patients, creating personalized care plans, improving diagnostic accuracy, and publishing internal medicine research.

 

To show that the client was well-positioned to advance this endeavor, the petition highlighted 8 peer-reviewed journal articles and 71 conference abstracts, including 17 first-authored abstracts. The client’s publications had been cited 56 times. Rather than treating these numbers as automatically sufficient, we explained how an adjudicator could view them as evidence of peer engagement with the client’s findings, especially where independent researchers relied on the client’s work involving pulmonary diagnostic challenges, rare lung conditions, sleep-related cardiovascular issues, and clinical decision-making.

We emphasized that the client’s research was not only academic, but also tied to real diagnostic and treatment challenges in internal medicine, including identifying rare lung cancer through misleading pneumonia symptoms and detecting asymptomatic cardiac arrhythmias during sleep in a patient with obstructive sleep apnea.
