Since his spouse was born in a country other than India or China, he was able to benefit from her current priority date under the rule of cross-chargeability. So, even though we filed his I-140 under EB-2 NIW, he was eligible to file the I-485 for adjustment of status to permanent resident either concurrently with the I-140 or after his I-140 approval and did not need to wait for the priority date for people born in India with approved EB-2 petitions to become current.
