Success Story: NIW Approved Without RFE for a Medicinal Chemistry Researcher Advancing Marine-Inspired Drug Discovery

Case Summary:
We are pleased to share that the client’s I-140 National Interest Waiver petition was approved without a Request for Evidence. The client holds an M.S. in marine science and works in the field of medicinal chemistry, with research centered on natural product–based research and therapeutic development in the biomedical field.
Research Focus
The client’s proposed endeavor was to continue discovering, characterizing, and developing bioactive compounds from marine organisms to support the synthesis and optimization of novel marine-inspired drug candidates. We presented this work as important to antimicrobial drug discovery, biomedical innovation, infectious disease treatment, public health, and U.S. healthcare system resilience.
The client is currently conducting research in a U.S.-based chemical and biological sciences setting, where the client continues work involving research in natural products, chemical biology, and therapeutic development. This current research aligned closely with the proposed endeavor and helped show that the client was already advancing the same work described in the NIW petition.
Evidence of Professional Record
The client’s publication record included 8 peer-reviewed journal articles, including 4 first-authored articles, and 5 conference abstracts, including 4 first-authored abstracts. The client’s published work had received 60 citations, reflecting use by other researchers in areas such as marine natural products, biosynthetic pathways, chemical scaffolds, and pharmaceutical development. The petition also documented research support from the Ministry of Science and Technology of Taiwan.
The petition explained how an adjudicator could reasonably view the record as evidence of field-level influence because 2 of the client’s papers were cited at notably high rates when compared with other Clinical Medicine papers from the same publication years.
How We Demonstrated Significance
The petition focused on the practical significance of the client’s research. We showed that the client’s work contributed to the discovery and characterization of marine-derived compounds, as well as broader advances in understanding chemical structures and supporting future drug discovery efforts.
The evidence also demonstrated that independent researchers had used the client’s findings in subsequent studies across related areas of chemical and pharmaceutical research. The client’s work was not presented as a general chemistry interest, but as a focused effort to address antimicrobial resistance through medicinal chemistry, marine natural product research, and next-generation therapeutic development.
Why the Case Met the NIW Standard
For the first NIW prong, we showed that the proposed endeavor had substantial merit and national importance because it addressed antimicrobial resistance, infectious disease treatment, public health, and biomedical innovation. For the second prong, we demonstrated that the client was well positioned through advanced training, peer-reviewed publications, citation impact, funded research, and ongoing research directly tied to the endeavor. For the third prong, we argued that waiving the job offer and labor certification requirements would benefit the United States because the client’s specialized work supports flexible, collaborative, and broadly disseminated research beyond a single employer.

By presenting the client’s work as a nationally important medicinal chemistry endeavor, and by connecting the client’s credentials and ongoing research to demonstrated scientific influence, we showed that the client met the NIW standard.
