Case Summary:  

We are pleased to share the success story of an I-140 EB-2 NIW (National Interest Waiver) approval for a computer science professional specializing in robotics and machine learning. The client holds an M.S. in robotics, and the petition presented a research-driven endeavor focused on advancing autonomous robotic systems that can safely and reliably operate in unstructured environments. Although the case received an RFE, the petition was ultimately approved after a strong response that clarified the national importance of the work and the client’s readiness to advance it.

Research Focus and Contributions:

As an expert in computer science, the client’s proposed endeavor is to continue research on developing state-of-the-art machine learning algorithms to empower general autonomous robotic systems capable of operating in unstructured environments, such as residential settings. In the petition, we framed this endeavor as important because progress in autonomous robotics depends on robust learning methods that allow robots to handle real-world variability, improve safety and performance, and expand practical deployment beyond controlled settings.

To demonstrate that the client is well-positioned to advance this endeavor, we emphasized a record of peer-reviewed scholarship and independent influence. At the time of filing, the client had authored 7 peer-reviewed conference articles, including 6 that were first-authored or co-first-authored, and 1 first-authored preprint. The client’s publications had been cited 124 times. We did not present these numbers as automatically sufficient. Instead, we explained how an adjudicator could reasonably interpret this citation history as evidence that other researchers are relying on the client’s work, which is particularly meaningful in a technical field where citations often reflect that methods or findings are being used as foundations for further research.

The petition also highlighted the client’s peer-review activity as another indicator of professional recognition. The client had completed 7 reviews, which we positioned as evidence that respected publication venues trusted the client’s expertise to evaluate the work of other researchers.

In addition, the petition included evidence of major funding sources supporting the client’s research environment and work, including support associated with the National Science Foundation (NSF), the Army Research Office (ARO), the Office of Naval Research (ONR), and Lockheed Martin. We used this to reinforce that the client’s research direction aligns with priorities that attract competitive interest from prominent research and innovation stakeholders.

The petition also noted the client’s current research role at a U.S. university, demonstrating continuity between the client’s established track record and the proposed endeavor, and supporting the argument that the client is actively positioned to keep producing impactful results in the United States

Support from Experts in the Field:

To further substantiate the client’s standing, we submitted 2 letters of recommendation from experts in the field. These letters were used to translate specialized technical work into clear significance by explaining why the client’s research contributions are considered novel and valuable, and how the work supports progress toward more capable autonomous robotic systems. The letters were presented as corroboration that aligns with the objective record of publications, citations, peer-review service, and research support.

NIW Approval and Outlook:

After the RFE, we prepared a detailed response that reinforced how the evidence satisfies the NIW framework by demonstrating the endeavor’s substantial merit and national importance, the client’s strong positioning to advance the work, and why it benefits the United States to waive the job offer and labor certification requirements. USCIS approved the NIW petition, reflecting the strength of the overall record and the clarity of the petition narrative.
