Case Summary:

While the O1-A visa benefits aliens of extraordinary ability in the sciences, arts, education, business, or athletics, those foreign nationals should at least have:

  • Sustained national/international claim.
  • Their achievement must be recognized in the field through extensive documentation.
  • Current/previous employment in a critical or essential capacity for organizations or establishments that have a distinguished reputation.
The NIW petitioners on the other hand must fulfill the below-mentioned prerequisites:
  • The foreign national must be in a position to advance the proposed endeavor.
  • The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2.
  • A proposed endeavor, holding substantial merit and national importance.
After completing his Ph.D. in mechanical engineering, our client, currently a Research Scientist from Taiwan, approached us to file his NIW (National Interest Waiver) and O1-A (Individuals with Extraordinary Ability or Achievement) petitions on his behalf.

His research addresses some of our nation’s most pressing issues in understanding how to develop large-scale, vascularized bone tissue engineering constructs to optimize drug screening and cell sorting methodologies. To wit, the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), the National Institute of Dental and Craniofacial Research (NIDCR), the Defense University Research Instrumentation Program (DURIP), and the Peer Reviewed Orthopedic Research Program (PRORP), Boswell Foundation funded his research. This funding supports projects that develop treatments for bone, muscle, and skin diseases; studies that advance dental, oral, and craniofacial health; projects that benefit Navy-relevant research; and projects that provide healthcare solutions for injured military personnel.

Consequently, to make a strong case in his favor, we included the following details in his petition packet:

  • His work has resulted in at least 20 peer-reviewed scientific articles, 3 book chapters, and 3 patent applications.
  • His publications have been cited at least 562 times according to Google Scholar.
  • He has completed at least 11 peer reviews.
He has even received 4 recommendation letters from his fellow experts in the field, one of whom remarked:
