Case Summary:
For this client, the central challenge was not establishing the value of the proposed research. USCIS had already agreed that the endeavor possessed both substantial merit and national importance. Instead, after the petition was filed on December 18th, 2025, and upgraded to premium processing on February 9th, 2026, USCIS issued a Request for Evidence (RFE) on April 13th questioning whether the client was well positioned to advance the proposed endeavor. The endeavor focused on advancing secure, decentralized computational frameworks for communication networks to protect sensitive data while enabling fast and reliable processing at the local level. North America Immigration Law Group (Chen Immigration Law Associates) therefore concentrated the RFE response on the second prong of the Dhanasar framework, addressing USCIS's concerns through a more detailed presentation of the client's research influence, technical contributions, funding involvement, peer recognition, and future plans.
A major part of our response involved putting the client's scholarly record into the proper context. The original filing documented 6 peer-reviewed journal articles and 8 peer-reviewed conference articles, along with at least 70 completed peer reviews. By the RFE stage, the client's work had accumulated 106 citations.
Rather than relying solely on citation counts, the response documented the concrete downstream implementation of the client's work. Independent researchers actively extended the client's studies in areas such as advanced wireless modeling, privacy-preserving machine learning, and low-latency network scheduling. The client's research was featured in foundational academic literature and directly informed technological standardization discussions. Furthermore, independent experts actively sought the client's technical guidance and source code to build upon the client's frameworks. Together, these examples directly addressed USCIS's concern by proving a level of sustained influence well beyond ordinary metrics.
The RFE response also clarified evidence that USCIS had questioned regarding federally supported research. Although the client was not listed as the principal investigator, additional testimony established that the client served as a core technical contributor to the National Science Foundation (NSF)-supported research involving privacy-preserving distributed learning.
The approval ultimately followed a response designed to show the client's record as a connected trajectory rather than a collection of isolated credentials. After responding comprehensively to the RFE, we were pleased to see USCIS approve the NIW petition on July 24th, 2026, and we wish the client continued success in advancing privacy-preserving AI and next-generation wireless communications.
