UNDERSTANDING YOUR NOTICE

What is an NIW Request for Evidence?

A Request for Evidence (RFE) asks for additional evidence or clarification before USCIS decides your NIW petition. It can question underlying EB-2 eligibility, one or more NIW prongs, or whether the submitted evidence establishes the required elements.

An RFE is not a denial. It identifies questions USCIS needs resolved before deciding the petition. The response should address every issue raised, explain how the evidence meets the relevant legal standard, and follow the notice’s submission instructions.

What we need to evaluate your RFE

Please provide the complete RFE notice, your original petition and exhibits, and the response deadline. These materials allow us to assess the challenged issues, possible response strategies, and the time needed to prepare the response.

Why your response needs an individual strategy

Two notices may use similar language, but the applicants’ qualifications, proposed endeavors, and original evidence can be very different. We assess what your petition already establishes, what USCIS disputes, and which additional evidence and legal arguments can address those concerns.

The RFE notice

Highlighted passages identify the challenge addressed in the response.

How this response answered the quoted RFE

The quoted RFE questioned whether others had used the applicant’s work. The response in this same case paired an independent research-user letter and a citing publication with firsthand supervisor letters to document both outside use and the applicant’s contribution.

Evidence added to the response

  • An independent testimonial letter from a researcher who used the work

Purpose: Confirm which research output the author used and explain its role in the author’s own research.

  • Selected citing publications and explanations of their use

Purpose: Point to the relevant passages in the citing papers and show how the work informed subsequent research.

  • Firsthand testimonial letters from project supervisors

Purpose: Confirm the applicant’s responsibility for the methods and results described by the independent researcher.

How we addressed the officer’s concern

When an officer asks how others have used your work, a letter can answer with a specific example of that use. In this approved case, we paired an independent researcher’s letter with the relevant citing publication. The author explained which data were used and how they supported a subsequent research framework. Firsthand supervisor letters then connected those results to the applicant’s own work, giving the officer a documented account of both outside use and personal contribution.

The I-140 petition was approved after the RFE response. The approval record does not state which individual argument or exhibit determined the outcome.

The RFE notice

Highlighted passages identify the challenge addressed in the response.

How this response answered the quoted RFE

The quoted RFE questioned whether the claimed impact was attributable to the applicant. The response in this same case used firsthand supervisor letters to identify the applicant’s technical work and an independent research-user letter to explain the subsequent use of the resulting data.

Evidence added to the response

  • Firsthand testimonial letters from research supervisors

Purpose: Identify the technical responsibilities, decisions, and results that the supervisors personally observed.

  • An independent research-user letter and a corresponding publication

Purpose: Explain how work attributable to the applicant was used in research outside the original project.

How we addressed the officer’s concern

Your individual contribution becomes easier to assess when someone who observed the work explains it in concrete terms. In this approved case, we used supervisor letters to describe the applicant’s role in developing methods, validating results, and producing research data. An independent research-user letter showed how the resulting data supported later work. Together, the letters connected the applicant’s own actions to identifiable results and outside use.

How this response answered the quoted RFE

The quoted RFE questioned the citation history and interest from other researchers. The response in this same case supplied updated citation records, selected citing articles, and explanations of how those articles used the applicant’s findings.

Evidence added to the response

  • An updated citation record and an independent-citation report

Purpose: Present the citation history with a clear distinction between independent citations and self-citations.

  • Selected citing articles with focused explanations

Purpose: Show where later researchers relied on the findings and what those findings contributed to their work.

  • An updated personal statement

Purpose: Connect the cited research to the applicant’s continuing projects and proposed endeavor.

How we addressed the officer’s concern

If the officer questions what your citations demonstrate, the response can explain the research behind the numbers. In this approved case, we combined the updated citation record with selected citing articles and explanations of their relevance. Those examples showed how outside researchers used the findings. The personal statement connected that record of use to the work the applicant planned to continue.

The RFE notice

Highlighted passages identify the challenge addressed in the response.

How this response answered the quoted RFE

The quoted RFE asked how many citations were independent rather than self-citations. The response in this same case provided an independent-citation report that classified citing works by author overlap, removed duplicate entries, and explained the eligible set used for the calculation. Selected citing studies also showed how outside researchers used the findings.

Evidence added to the response

  • An independent-citation report with an author-overlap analysis

Purpose: Distinguish citations by independent researchers from citations sharing an author with the cited work.

  • A documented count of the eligible citing works

Purpose: Remove duplicate entries and make the basis of the independent-citation calculation clear.

  • Selected citing publications and explanations of research use

Purpose: Show what the independent researchers used and how the findings informed their own studies.

How we addressed the officer’s concern

If your officer asks how many citations are independent, the response can make that distinction verifiable. In this approved case, we used an independent-citation report to separate citing papers with overlapping authors from papers without that overlap. The report documented duplicate removal and the eligible set used for the calculation. Selected citing studies then explained the significance of the independent attention, connecting the count to actual research use.

The RFE notice

Highlighted passages identify the challenge addressed in the response.

How this response answered the quoted RFE

The quoted RFE questioned why a job offer and labor certification would be impractical. The response in this same case explained the continuing research program across projects and settings, its fit with a fixed position’s requirements, and the additional research benefit supporting the waiver request.

Evidence added to the response

  • A personal statement explaining continuing projects and collaborations

Purpose: Describe the research activities, anticipated outputs, and collaboration across research settings.

  • Current training and employment documentation

Purpose: Support the practical account of how the applicant could continue the research.

How we addressed the officer’s concern

When your RFE questions the need for a waiver, the response can explain how your actual research program would continue. In this approved case, we described work spanning projects, collaborators, research settings, and shared outputs. We explained why that continuing endeavor was difficult to capture within one permanent position’s minimum requirements, and described the additional research benefit the applicant could provide even if qualified U.S. workers were available.

The I-140 petition was approved after the RFE response. The approval record does not state which individual argument or exhibit determined the outcome.

QUESTIONS ABOUT NIW RFEs

Answers before you take the next step.

Does an NIW RFE mean my petition will be denied?

No. An RFE asks for further evidence or clarification; it is not a denial. The next step is to identify the issues in the notice and assess what the existing record and available evidence can establish.

Is a high citation count enough to answer an NIW RFE?

A citation total can be relevant, but the response should explain what the evidence demonstrates about the proposed endeavor and your ability to advance it. The notice determines which issues need to be addressed.

Can my NIW response use evidence of industry impact?

Yes, where relevant. For example, documented adoption, implementation, or other independent use can help explain the impact of your work. The appropriate evidence depends on the endeavor and the questions in the notice.

How long do I have to respond to a NIW RFE?

Most RFEs in our recent firm records allowed only 30–35 days to respond. Check the exact due date on your notice and seek an attorney evaluation promptly. Our attorneys can review the challenged issues, assess the available evidence, and plan a response around your deadline.

Can you review an RFE if another firm filed the petition?

Yes, you may request an evaluation whether you filed on your own or with another law firm. We review the original petition, the RFE, available evidence, and deadline before deciding whether we can accept representation. If we take the case, the engagement agreement defines our work on the response.

How do you keep response strategies current?

Our attorneys review USCIS policy developments, applicable legal standards, and recent adjudication results. Team discussions and our case research help inform the analysis, while the strategy remains specific to your petition and evidence.

What should I do first after receiving an RFE?

Locate the exact response deadline, keep the complete notice, and contact your attorney promptly. Have the original petition and exhibits available so the review can identify which issues are new and which concern evidence already submitted.

Is the RFE response deadline the same as USCIS processing time?

No. The response deadline is the time allowed to submit your response. USCIS review after submission is a separate period. A shorter response window does not mean USCIS will decide the case within that same number of days.
